The issue is the legitimacy of the first marriage which they are questioning. I don’t see how this new filing addresses that. Am I missing something?

I have no idea what you are missing.

 

I am telling the OP that a lawful avenue exists to file for (new) permanent residency on the basis of his current marriage now a denial letter has been issued.

OP said spouse is a PR. Maybe spouse can file for citizenship concurrently with OP’s 751, it might make things faster. (Though as I say, “fast” and CIS should not be used in the same sentence)

Hey wanted to share my experience with getting a stamp after my first i-751 was denied and filed a new one.

 

i called USCIS and waited 31 days for a call back. Lucky me i had an appointment the next day. 

 

this is my 11th stamp so I know the drill but this was my first time i asked for a stamp on a new filed 751 after first was denied.

 

after giving my passport and asking for the stamp the officer came back and gave me my stamped passport. i asked him:

 

Can i still work and travel with this?

he said yes you can

"even though you guys denied my first application?"

He said: " yes, now you have new application, and its pending. even though we denied your first application we, USCIS can't take your greencard from you, only the immigration judge can take it" 

 

the weird part i got a stamp for 2 years that i noticed later that day. maybe because i came with my new receipt number with 2 year extension ?

2 year stamp? Thats new. They weren’t giving 18 month stamps with 18 month letters, so that’s unlikely to be the cause. 
I need a new one shortly as my current is expiring - my twelfth I think 😂 - so maybe that’s the new thing now.

I hope so, as it’s a chore having to do it annually .

 

Yes, you can work and travel. You remain a LPR until an immigration judge says otherwise.

I just honestly wonder what/ if they feel something when they see you coming for the hundredth stamp. I'd be like OMG, let's just get this moving for this guy, but I guess they don't perceive things the same way. They're just their own little bubble.

have you travel outside the country while your i-751 was denied?. 
 

i have traveled outside while my i751 was pending and on removal proceeding and had no problem coming back in. However the his time I received a denial letter
