Minor criminal history, did I screw up?

I filed i129f a few weeks ago.

 

There is a charge for some form of minor assault during highschool. I was questioned but never arrested and didn't ever see a judge, but it was easier to accept community service for a couple days as a punishment instead of fighting it. record was expunged automatically.

 

I have never seen this in any background check, and no employer has questioned it. Even my fiance's relative knows somebody who works in government and did a background check on me (for my fiances safety). They didn't see anything. I was squeaky clean. So I didn't disclose it on my i-129f (but I did tell my fiance about it).

 

Now I'm reading horror stories about people being denied because they didn't disclose expunged records from decades ago. 

 

I'm worried. Can I amend my original filing? Should I be worried? Should I call USCIS?

Assault is minor?  This is a big time error, imo.  Who ordered the community service? Sounds like a conviction.   I would prepare myself for a denial at some stage....maybe after the interview.  Personally, I would withdraw the petition, and resubmit a new one...or marry, then file a CR-1.   Calling USCIS will be useless.

I barely remember anything about it, or even if was labeled an assault charge. I just think it was, somebody said I left a bruise on their leg. You really think I should bite the bullet start over?

 

Are there any cases of people just getting an RFE, or the charge not coming up at all?

You must contact the court authority and get either the original disposition records or an original letter stating that no records exist.

I can't answer that.  I know that @John & Rose married after the denial, then refiled. His spouse received a CR1 visa with no issues.

Would it be wise to put a reason for cancelling the i129f? Or just as ask them to cancel the case?

If you are a petitioner you have nothing to worry about as long as your crime did not involve assault or sexual  related crime to children.

 

Since, it was an assualt it will not be a problem as a petitioner.

 

Do not listen to Crazy Cat you are a US Citizen you have nothing to worry about filing a petition.

 

Hell, I have seen people filing for their spouses from prison.

You are 100% wrong......  A finace petition is NOT the same as a spousal petition.....

I agree do not listen to anyone they are giving you bad advise. You said it was in high-school so I'm assuming you are under 18 at the time? 1. If you were a minor it's not going to be on any permanent record. 2. You are a US Citizen and the petitioner so it doesn't make a difference.
