Hi there: ) I am in the process of getting all the I-129 paperwork together, but I've ran into a problem. My fiance is currently in the Philippines, but has been to the United States before on a tourist visa. On the I-129 Form, it asks for the I-94 arrival/departure record number, date of arrival and date authorized stay expired. However, she lost her I-94 paperwork from she was in the states. My question is if it will cause a problem or delay in the process if i left that area blank or if anyone knows what else we can do on how to obtain this information, perhaps the embassy in manila still has records. thanks!

Hi there,

that is point 12 on the I-129F form, right?

It says there: 'if your fiancée is currently in the US, complete the following'... but since she is not with you right now, you do not have to fill in any information, just put n/a. They do not want old arrival/departure numbers.

Hi, thanks for the reply Liebi: ) I guess the example I-129 form http://www.visajourney.com/examples/INS-Form-I-129F.pdf they have on this site is kind of misleading. Because in the example form on section 11 where it asks if fiance has ever been to U.S., it said yes. Then in section 12 (the first box), like you said it says FILL only if fiance is in the U.S. at time of filing, otherwise put N/A. So I would put N/A in that box in my situation. But in the example form in section 12 (the next 3 boxes), it has it filled out w/ the record #, date of arrival, and expiration date as shown on the I-94. So I was confused if I had to fill that out also from the time when my fiance was in the states or if i was to leave it blank, cuz according to the example i would put N/A in the first box of section 12, and in the last 3 boxes i would fill in the info from the time my fiance was in the states. I really just wanna make sure i'm doing this right the first time. thanks for ur help:)

The example form is not misleading, it's for a situation that is different from your own. For someone else, the example form is perfect.

That's the danger with example forms - one has to be aware enough to realize when the example does not apply to them (and those who are sufficiently aware usually don't need an example to copy from).

Well actually the situation in the example form is the same as mine, because the fiance has been to the states before just like my fiance (question 11). And in the example form in question 12, the first block was left w/ N/A, but in the next couple blocks the form had it filled w/ the I-94 information, which is why i thought i needed that info also, from the time my fiance was in the states.

No, the example on the example form IS different than yours, as the foreign fiance on the form is in the US as the petitioner is filling out the form. Thus, the I 94 is in the passport.

Your fiance/e is not in the states with you now (at least not according to your original post), and as I 94s are supposed to be taken as you exit the US, your fiance/e would not still have an I 94 to refer to.

Just put N/A in all those boxes, since your fiance is not in the US, you don't have to fill out that part!!!
