Hello,

My EAD is approved but I still don't have a SSN, I've been told it keeps getting automatically deleted from the system because we didn't get it processed before the 90 days were over so we had to wait until I've got my AOS to apply for one again. Is it possible to apply for a SSN once I get the EAD or do I really have to wait for the AOS? Our AOS is still being reviewed because of an RFE.

Also, is it possible to work with my AOS pending or without a SSN but with an EAD?

Yes, your EAD should allow you to apply for a SSN.  You are authorized to work.  I sincerely doubt an employer will hire you without a Social Security Card.  They can't pay you without it.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Not entirely true.  Other work authorized visa types can obtain employment without a SSN and provide it at a later date once it's received.  The IRS doesn't get paid without it and, of course, they want their cut.

Employers have a short window to provide your SSN by law.

Most will not hire you and allow you to work with out one.

Same boat. Wife got her EAD (we applied for SSN on the EAD application) but no SSN yet. More than a week has passed since she got EAD. Will wait one more week before probably going to SSN office in person. We need SSN for joint account and interview is coming up!!

Personally I wouldn't trust applying for a SSN on any of the USCIS forms. Better to go to your local SSA (they may require an appointment these days) and get it done yourself. And yes, you can definitely apply for a SSN with your EAD, so no need to wait, just go get it done. You will not be working without an SSN.

You can get a job as an independent contractor or 1099 employee, then technically you wouldn't need your SS number until your employer files the 1099-MISC with the IRS in January or February of next year. You should have it by then. Just kinda limits you on your job search, and type. But as others have said, go to the SS office directly, but it will still take a month to get roughly. I have heard as fast as 2 weeks, but it has been slower lately. When my wife first got hers in 2019, it only took a week.

its up to each employer if they hire without the proof of SS card / some hire knowing they have a few months to have copy of the card 

 

since they  report our SS withholdings quarterly when they send form 941,  they pay the employer and employee's portion  for end of months March, June, September and December 

 

Form 941 is due at the end of the following month. This makes the due dates April 30th, July 31st, October 31st, and January 31st

 

if working  is important ,  don't wait for USCIS to do the work,   make the appointment at SS office , take your EAD and other needed documents and apply
