Hi all,

 

i searched in the bar and saw some posts with conflicting advise.  My husband and I were just married last Friday and we want to get the ball rolling ASAP on filing 130, 130a, 131, 485, 765, 864 and 1145, but due to our recent marriage, change in plans in even getting married in the first place, and his living/bills situation, we don’t have a lot to work with for bona fide evidence, specifically in the joint finances and accounts category.

 

I see some posts saying save it all for the interview and others making it sound like way more than we have is necessary. 
 

fwiw, he is USC by birth and I’m Canadian.  All we have are photos that are geotagged and time stamped with us together on our own, at various events, or with family in various places across the US and Canada between 2019-present, the plane tickets that match said photos, our marriage certificate with a couple nice wedding photos (courthouse with 5 non family attendees), and other than that I have a library card and a gym membership that lists my physical address the same as his, and I also have my name on his PO Box where we get our packages sent.
 

he has had a really informal housing agreement with extended family for 10 or so years so there is no actual lease, and all the bills are in the families name, as well.  Cable, internet, heat, everything, it’s all included in the agreement so his name isn’t on anything for me to join on.  Could I even without a ssn?  My phone is now on a family plan shared by myself, his mom, him, and his sister but even then, I think he just transfers her the money monthly. They are grandfathered into a plan rate we could never replace if we ventured off, lol.  So avoiding little changes like that is ideal, at least while I’m not yet working.  In the end, we will do what we have to do, though.  As for having my name on car insurance, I’m under the impression my Canadian license isn’t even going to be valid the moment I drop this packet in the mail, and I don’t even know if I am eligible to be on his health insurance without a ssn, we find out next week…HR is already on it. There is so much going on that I am learning about day by day here. 

 

should I just file with what I have (req. copies of certificates, ID, forms, fees, passport photos, gym/library/po box, his income stuff, etc) and then continue gathering evidence for the interview, which by then should be the sufficient amount of ‘co-mingling’, or should I hold off filing for a few weeks/month(s) to try and get my name on some more ‘important’ things that prove we are in a legitimate relationship? Sooner this ball gets rolling for me, the better.  But obviously I don’t want to shoot myself in the foot by not having enough ready.

 

has anyone ever gotten an RFE at the initial filing?

RFIEs are issued frequently.  I assume you are in the US right now.  If so, I would file the I-485 package as soon as possible.  There are no benefits in waiting.  If you, both, are in the US right now, use this guide.  Be aware that you will not be able to work or leave the US for up to 8 months.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I'd say send as much as you have upfront.

 

My interview got effectively waived because they supposedly had enough evidence and we filed like four weeks after we got married with zero bank accounts/CCs/insurance docs (except health insurance) at the time. We sent a lot of our travels (hotel bookings, flights and boarding passes, restaurant reservations, concert tickets etc) and gifts between us as well as cards between us and a couple from other people addressed to both of us. Oh and of course some engagement rings/wedding related stuff (even though we literally only had a wedding that was signing a piece of paper in an office that we got dressed up for nicely). Just to name a few things.
