Hello, i had filed and i130 for my spouse last year and we got approved ;case has been in NVC since. Weve been together and in this process for a year and a half. Recently about a month ago we got in a huge arguement and i was angry and did everything i can to withdraw the case! I sent a letter to USCIS and NVC expressing my feelings and anger i even uploaded it on cseac. We recently ended up mending things and working out and got back together a month later due to things that happened in my life. After we fixed things i sent a letter to NVC and USCIS stating to no longer with draw but by the time i did that i have recieved an email from NVC stating the case has been sent back to USCIS. What can i do now? If they decide to reopen it how will the interview be. For someone who had a similar problem as mine and had refiled in the interview do they mention the old case? Or if your case reopened do they mention the withdraw?

They won’t re open. They’ll just go by the new application.

 

I’m pretty sure they do. They can if they want to.

I mean, they said petition went back to USCIS so I’m thinking the withdrawal has been communicated

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

So, she doesn’t know? What kind of things did you write it? Did you told something that can hurt her like claim that she was trying to scamming you?

Withdrawals are irrevocable.  You have to start the process again.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Oh, you didn’t tell your spouse!!!

Of course they can ask about it at the interview. And if he finds out at the interview, it might raise a red flag over the bona fide of your relationship.

What you did has a very profound impact on their immigration case. They might not trust you if they find out through another person other than you.

Before doing anything else, come clean with your spouse. 
I mean, as of now, refilling seems to be your only option. Your spouse will have to sign the forms again, you think he’s not going to ask why he has to sign again when he’d already done it?!

yes,   he will learn of this as he knew it was at NVC and now its going to take  new petition and another year

and the CO will more than likely ask "why u withdrew it the 1st time "  and he must be able to answer this (and all other questions ) to prove the relationship

we have no way of knowing why you were so angry buy he has too and now,  u must convince each other that you have the trust needed for a life together 

remember ,  this hurt u both
