I-130 PD 9/23/21 IR1. We are in the UK and have been married nearly 12 years. We have resided in the UK for 12 years. I am USC and my husband is UKC. Our case was moved from Nebraska to Vermont. Nebraska was passed our priority date so I inquired through the live chat on USCIS and they informed me it had been moved to Vermont which means another 12-16 months. I am trying to stay positive here but it is very difficult. I was hoping to be home by the end of the year. Can someone give me some positive energy here? Are we really going to have to wait another 12-16 months? Would it be worth it to try and get it expedited?  How would I even do this? The only reason I can think to give is that my elderly father is not in great health and I would really like to see him before it's too late. Any consolation would be great. Thank you.

The months counting is from your PD date.  Mine was processed in Vermont (accepted from Nebraska, reassigned to Vermont the next day).  PD 09/20/21, approved in 50 days.  I was expecting 12 months.  I sent in K3 after 2 weeks of my PD.  Maybe you send in K3?  It's free.  Just trying to give you good vibes.  Blessings to you.

Here’s a K3 applicant who recently posted in the UK forum. There aren’t many around. She has a great timeline and comments on her timeline page about  her I-130 petition stall out. Her I -129F petition was approved in 7 weeks. There’s no charge to submit that petition when you send a copy of your I-130 NOA1 with it.

You would skip all the NVC processing and document submission and pick your own interview date like a fiancé visa. But the K3 would require adjustment of status in the US before a greencard would be issued.

Positive vibes:

Same thing happened to us! We submitted out I-130 in July 2021 and Nebraska was on our NOA1. The discovered it moved to Vermont late 2021. Luckily our NOA2 arrived Day 260. (We did not submit a K3 application.)

 If everything goes well I'll interview 13 months after submitting the petition. 

 

NVC processing times are speeding up and DQ to interview for UK also seems to happen very quickly.

So, there is a good chance he'll receive his visa by the end of 2023.

 

An alternative to waiting in the UK together is for you to move to the US ahead of your husband. Quite a few couples do that...

This process really is random.
