Wait, you said "he's done HIS tax returns" but you're married. You two should be filling "married".

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

I have no income. He has my ITIN number. I'm assuming that's what you mean.

You said “he has his tax returns”. Usually people that file jointly would say “we”. I was just checking, that’s all

Your other option is to return to the UK if you don’t have anyone willing or able to be your sponsor.   As things are, even if you filed today, it would be up to 8 months before you’re authorized to work.

 

Sounds like maybe none of this immigration business was planned for at all.

It was... But the family interfered, some things that could not be helped happened, and just went nuts.

It’s not only about him. It’s also about his spouse his brought to this country and who is now going through hell.

 

Its also illegal to work under the table. He needs to do what is right and needful, that’s get a legitimate job.

I wonder, is your current marriage bad enough that you could say it's abusive? If so then you could try a VAWA case instead of trying to make this deadbeat grow up.

Contradictions without citations only make you look dumb.

Her husband is not abusive. Can’t just use “abuse” for any circumstances. That’s not how it work. 
 

OP. Ask ur husband to ask his employee that he wants to pay tax and not “under the table”. I know the money is less but this is ur life too. Can’t choose money over your situation here in the states

VAWA is not a one-size- fits-all. And filing VAWA when there really is no reason for it is a disservice to the true victims.

I agree it isn't, but you don't need violence to hit the standard of extreme cruelty. Besides, I'm just asking a question, maybe it's enough of a dumpster to qualify, maybe it isn't, won't know until OP comes back and answers.

 

Also, the attitude a lot of people (including you) have towards VAWA is the real disservice that only causes people to normalize their abuse because there's always someone who has it worse.

He doesn’t have to find a new job.   He can pay taxes on his income. 
 

Let’s say a W-2 job pays him $25,000 a year.  
 

A W-2 job pays income tax and the employer side of 7.65 percent social security tax.  
 

A non W-2 job is a self employed job. Self employed people pay both employer and employer side of the social security tax, so a total of 15.3 percent aka self employment (SE) tex.  However the income subject is income tax is reduced half the SE tax.  
 

So let’s say he pays 5 percent over all on jocks taxes.

 

W-2 job:  

 

* gross income $25,000 . This is the number used for I-864

 

* SS tax: $1913

 

* 5 percent income tax on $25,0004 $1250

 

* net after income and SS tax: $21,837

 

Self employed job:

 

* gross income $25,000.  
 

* SE tax: $3,825

 

* deduction for paying SE tax;  $1913

 

* income subject to income tax: $23,087 (the number that should be used for I-864)

 

* 5 percent income tax on $23,087: $1,154

 

* net after income and SE tax: 25,000 - 1154 - 3825 : $20,021
