I didn't think I had to add him or state that I was married on my last years tax return since he's not here in the states yet and we got married Dec 2020. I know to state that I'm married this year as I have not filed as of yet. Thank you for your reply

From the year that you are married, you have to file as either "married filed separately " or married filed jointly". It does not matter if your foreign spouse is not in the US, u can still apply for an ITIN number for them thru the IRS. They may ask to see your most recent tax return When your spouse interviews,  and if it says you filed as single that can be an issue and cause further delay.

You should not have filed as single for 2020 and 2021.  Married is married.....

you were married at the end of 2020 , you have to file as wither MFJ or MFS / u were no longer single at the end of 2020

Hard to prove you have a real marriage to one US government body (immigration)  when u you say not married to another (IRS)

u can correct this with a 1040x

U do need to get those 2021 taxes done as they will be needed at the interview / if he does not have them, he will be given a 221g  stating they are needed with an updated I 864 and the case is in limbo at embassy till the forms are received  (AP administrative processing )

Current income is needed and the latest is 2021

Best to u both

My husband and I case has been stuck at in Lagos NVC for over a year now. Our priority date is Jan 24th 2021 we have been waiting for an interview for a long time does anyone have any idea on when they will be sending out an interview dates and times? This wait is ridiculous and way too long I thought the embassy was moving faster.  In the mean time I filed a 129F form for a K3 visitors visa I just got a letter today saying it was denied because they already approved my husbands 130 form. Is there any way around this wait? It's getting pricey to keep traveling from the US to Nigeria every 4-5 months I'm getting worn out. 😥 I need some positive vibes & energy today I'm a little bit discouraged. I'm just ready to start my life with my husband in the states already *sigh*

Check your email IL's just went out for Lagos right now I see all the way to DQ Jan 7, 2021

DQ'd is documentarily Qualified. That's when NVC has accepted all your documents and DQ'd you and put you in the Interview Queue. When were you DQ'd?

Oh wow! thanks for the update I thought it was from the day you submitted or filed for your spouse. I just looked at all of my paperwork online and it looks like I have all green checks on April 2021 and some for June 2021because they kept rejecting my form because it was expired and I didn't know it. It took me weeks to figure out the the form at the very right hand corner has an expiration date ( I864 form) but everything else was accepted back in April expect for that one form. They finally accepted that in June.  I really hope that they wouldn't start my DQ date from June If everything else was submitted and accepted in April.
