You said you reported the ex to USCIS (wrote letter) on September,2019 …maybe saying that it was not a real marriage…or that he tricked you ( married for papers) …they won’t write you back , by the way.

I think you will have an uphill battle to get this I-129 F approved. It’s way to soon after the divorce, it’s on the heels of you just telling USCIS that the last Petition for ex( well you thought was real, told USCIS it was real) but then realized he fooled you and maybe both you and USCIS were defrauded by your ex…

Even if you married the new fellow, and filed another I-130…it will take some time and some challenges to make it work.

No, I write to Uscis on September 2021. On September 2019 was his arrival to the country.

ohhh ok, I see. I thought they send me confirmation or something that indicated me that they received the info I send.

When I filed the I130 and I 129f I was very concerned about that my way through Uscis will going to be hard due to this stupid guy (ex-Husband), Uscis May think that i made fraud but is not. My ex defrauded me and Uscis as you says.

I divorce him. Divorce was finalized October 20 2020. I get married to my actual husband May 8 2021. My exhusband doesn’t have a proof of bonafide marriage because he did not even got a picture with me. He left me after arrival.

I just noted u are trying for a K-3 !  Is your I-130 ( current husband) still pending? Did they RFE for anything?

Yes is still pending. No RFE. Actively reviewed since October 4 2021 at Vermont. I will be a year filled on May 14.

I see…so there are a few complications here. I take it you divorced the fellow who betrayed you sometimes in 2021…Who filed for divorce, you or him?

Your ex will gets to file for I-751 waiver ( for divorce) and just has to show that the 2 of you had every good intention of staying married, proof that you lived together / marital union from January 2019 until whenever you separated and then divorced.

Correction typo September,2019 should read September,2021

Children are evidence that you had unprotected intercourse not that you have a bona-fide relationship 😉

Anybody know why they are asking me for my fingerprints?

After reviewing your post history, USCIS could be scrutinizing your past history.  You said you have had difficult interviews, a previous spouse who tried to bribe you for immigration purposes, etc.  Maybe your ex-spouse has implicated you in some misdeed.  This is rare that a petitioner is asked for finger prints.  Good luck in this journey.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

They ordered fingerprints to go through thorough background check to see if you have any criminal history and not using the system to help immigrate foreigners to US for money.

They routinely perform background checks on all petitioners, but they very, very rarely ever want finger prints from petitioners.

Interesting to see they've requested fingerprints for the K3 application and not the I-130.

Confirms my suspicions USCIS doesn't just connect the I-129F to the I-130, denying the I-129F without reviewing it and then approving the I-130...

People are adding to USCIS workload by submitting a K3.

@Jeniffer are you US born or did you acquire your US citizenship through a spouse or family member or other?

Fingerprint requests aren't that common for spousal visas but I have seen a few requests when someone petitions a few spouses or the USC has a criminal record.

Hopefully you will be cleared and your petition approved.

I’m US through my dad. Last time immigration service has my fingerprints was in 2012 when I give back my green card and they give me the citizenship paper.

For me is the first time I see that.
