You have not provided enough information to answer.  

Why did you need a waiver?

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I was found inadmissible for material misrepresentation in 2020 for submitting a fake divorce decree .I was giving a waiver and a refusal letter . later down the line I was issued a NIOR to submit the proper divorce decree and was only given 30days which I never responded to because I do not have the divorce decree because I was never previously married and it was  all lie in my previous application to obtain a B1/B2 visa .  I filed the i601 waiver for a Pardon and i told the truth in the waiver before I Got the NIOR from USCIS which I did not respond to. I checked my i130 recently and it says my i130 has been revoked although the waiver is still awaiting approval . does the i130 revoke affects the i601 awaiting approval? Or its a normal procedure for USCIS to do that .I just need someone with similar experience

Thanks for the explanation.  An I-130 is the basis for an immigrant visa.  If the I-130 is revoked, the case is dead.  The waiver is dead.

I'm sorry, but my understanding is that it is very hard to get a visa even with a waiver under your circumstances.

The waiver is contingent to the I-130. Once the I-130 is revoked, the case is dead, so they most likely will not consider the waiver.

I have never seen a case like this end well for the person who lied on the B2.  Thank you for giving us this valuable information.  We would appreciate any further updates in the future.

On what basis were you able to submit an I 601?

 

Do you have a Lawyer?

 

Were you interviewed, refused and given the option of filing a waiver?

Yes I was interviewed in 2020 DEC and I was giving a refusal sheet with a waiver eligibility and it I have an attorney but they are just not responding anymore they filled my waiver but they don't respond to questions.... I showed them my NIOR but they said it has nothing to do with me

I'd say that was not accurate since the I-130 was subsequently revoked.

The NOIR should have been answered....period...even if you answer with redundant documentation.  NEVER ignore a letter from the US government.  EVERY competent attorney knows this.

They sent the NOIR because they have to follow the steps. Whoever gave you the advice to ignore it (who was it?) was wrong, never ignore a letter from a US federal agency.
