Hello everyone,

i have a question regarding the Class of Admission on I-130 online form.

I only travelled to the US through an ESTA from Germany and i’m currently not in the US. Would my answer be correct?

Thanks

Sabrina

Just pay close attention to each question.  Class of admission is for people currently in the USA.  The passport information onward in that section is for everybody.

This thread helped me realize that I also made a mistake here. I want to say that the online form doesn't clearly state "if the beneficiary is still in the US" like the physical I-130 does, but I could be completely wrong and simply missed it. Perhaps this is something that online I-130 filers should be careful of.

Here's hoping it's obvious from my wife's departure record that she left the states and we don't get hit with a silly RFE.

You only answer that question if you’re currently in the US. That’s what the question is. Good luck! 🍀

The point is that the paper form makes that clear if you are paying close attention but the online form does not.
