My cousin were denied months ago at their K1 interview in Ghana , last three weeks we got an email requesting she should schedule an interview again and bring necessary documents to the interview. When additional information was sent to the Consulate by her Attorney. She’s not interested anymore. She got married and her husband applied for spouse visa for her and she’s waiting for Cr1 visa interview.
NB: Also the consulate asked them to follow the introduction for spouse visa and the K1 case would be sent back to uscis.
records indicate that she was previously found ineligible to receive a visa under Section (212(a)(6)(C)(i)) of the Immigration and Nationality Act (INA) for committing fraud or misrepresenting a material fact to a consular or immigration officer in order to obtain an immigration benefit under U.S. law….
The question is,
1. her misrepresentation of material fact has been forgiven and not on the records?
2. She want to know if it will not affect her cr1 visa interview?

She married a different person? I'm confused

Maybe I am not understanding correctly but something doesn't sound right.

1 Everything stays on the record

2 Yes it will

Marriage does not cure all K-1 issues.

1.  Misrepresentation is very serious.  It isn't just forgiven.  Maybe, it can be waived.

2.  Absolutely, it can.

Why exactly did she get the ban? What did she do? I ask because there's another ongoing thread over a ban that seems to have been recalled by embassy. Maybe her's is of the same nature.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

1. No, everything is on record. What did she misrepresent?

2. Yes, it's possible.

So what did she do?

INA 212(a)(6)(C)(i) provides that "any alien who by fraud or willfully misrepresenting a material fact seeks to procure (or sought to procure or has procured) a visa, other documentation, or admission into the United States or some other benefit provided under" the INA is ineligible.

INA 212(a)(6)(C)(i) denial because of mistake by Ministry of Foreign Affairs on divorce cert? Are you sure she has told you the whole story of the interview?

Okay but why are you saying her case isn't misrepresentation.

No, I would need to know why they made such a finding, I assume they have good cause
