Good evening - my wife and I are having a bit of a problem with our immigration documents, and I was hoping that there might be some people here who can provide some insight. 

 

We filed in February of this year (2022), and I provided all my pay stubs as well as a letter from my employer showing that I had sufficient income to support her. I had not filed my taxes at that point, and I have been a student so I followed the guidelines and put my projected income. 

 

We received a notice and Request for Evidence in March stating that they need evidence supporting my income, as there was insufficient evidence to show that I actually earned what I said I did. 

 

The problem is this: I have since filed, and we filed together (MFJ). The accountant did not listen to me and put her income as 0, even though we marked the forms when we originally submitted showing that she had worked without a permit for a short period (since immigration lawyer said to be honest and that it would be forgiven). 

 

The return does not differentiate between her income and mine, however. Due to an IRS mess-up, they have still not filed the return, and thus I cannot submit an amendment. ALSO, I have a joint sponsor who is willing to co-sponsor my wife with me when I submit the RFE

 

Do I need to write something and include it with the documents to USCIS for the RFE stating that the accountant messed things up and we'll be filing an amendment? Should I submit my newly filed W-2 (NOT TRANSCRIPT, SINCE THE IRS MESSED IT UP) with the RFE, or just resubmit the original documentation I had submitted with the joint sponsor paperwork?
