I was recently fortunate enough to earn an offer for a career position at a US company, to commence as soon as I’m in the US with my USC husband.

 

Due to ongoing delays and arbitrary errors at the NVC stage that we, nor our attorney were prepared for, the timeline for my CR-1 interview is still unknown.

 

As a result, I am about to lose the job offer, despite the company extending lots of patience so far. 

 

My question: is there a work permit I can apply for while waiting on this heartbreaking, uncertain process?  At the moment I am still in the Netherlands. The company is not able to offer this position in Manhattan remotely.

 

Please respond if you have RELIABLE information. Please also be kind… I’m heartbroken at the moment due to this NVC process and being away from my husband and young stepson. We are devastated due to the process.

Work visa through the company.......their attorney would handle it.  That would still retire time to process.   Most of us have had to experience being apart from out families during the immigration process.  Patience is the key.  

Thank you, Crazy Cat (love the name!) we looked into that already and indeed would take too long and too uncertain. Uncertainty isn’t good in business ;-(

Thank you.. I’d be happy with just one! I would be interested to know if it’s possible to file via the employer while still having the CR-1 pending.

Very possible...but as already mentioned, takes time too. It's not like you're going to get it in a month..

 

Additionally, employer has to file...

Maybe ask them for another extension? They may be willing yet again 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Any work visa will need to be applied by the Employer's attorney and tend to cost a lot to the employers for the process. most of the types (H1B, L1) are usually used for STEM only. it generally has to be for the rare positions where there is enough shortage to be successful and provide enough benefit to the employers to even bother

Thank you.. I was concerned that if I have the CR-1 running then another application would be out of the question. Clearly worth following up on. Thank you.

the work visa process would not interfere with the CR1 at all. Although, it would not sound practical to apply for any work visa's that are not dual intent as the chances of approval will be extremely low.

Theoretically yes but depends which one, some would take longer than your current process

Sorry, there is no way to speed things up.  

You can not apply for a work visa.  The company would have to apply on your behalf.  It's a process that cost time and money.  The reality is that it would probably take longer for the company to get you a work visa (if one is even possible) than for you to get a spousal visa at this point (being at the NVC stage).

You might be able to apply for an expedite due to financial loss to a US company... 

although the consulate does contain the instruction not to quit a job, sell your house or make any big changes before the visa is secured. 

And they might say you jumped the gun by accepting a job offer before being DQ'ed/interview/visa was issued. 

 

ETA: Please fill out your timeline. It will help others from the same country figure out how long the wait is between DQ and interview.
