Timeline

Hello,

i am a spouse of usa citizen and my last day to exit usa was april 20 , 2022.I had dispatched my concurrent filling of  i-130 and i485 through fedex on april 10th and the document were received on 12th april morning.Mode of payment was through credit card.

I have submitted following forms

1.i-130

2.i-485(concurrent filling)

3.i693

4.i130A

5.i864(affidavit of support)

6.i765

7.G1450 for beneficiary and petitioner

8.G1145 For beneficiary and petitioner

9.i131

10.i94

My question is do i need to worry about my exit date as it is quite near.I had a talk with uscis helpline and they suggested me to talk to attorney to update my i94 which i do not understand.Am i okay to overstay till my application is in process even though i have not received any receipt number ?The payment has not been deducted yet.

Too late to worry now.

Rule #1: don't listen to the "helpline". They're just contractors that read off of a script. You cannot "update" your i94.

Yes. Once you get your receipt number, you will be in a period of authorized stay.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Once you have sent a proper I-485 package, you are granted "authorized stay" until the I-485 is either approved or denied.  I would hang on to my mailing receipt and wait.  You do not need an attorney for this.  

You might want to change your profile since it says "Ir-1/CR-1".

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
