Ceac status says refused (merged)

I am wondering if other k1 visa applicants are experiencing this issue as well. I was going to hold off saying something but I felt this should be addressed. My filipina fiancee in the Philippines had her k1 visa interview back in April 7th. She was told that she had passed the interview but she needed to get an updated nbi and police clearance and submit them with her passport, which she did. She has not heard anything since then. As a matter of fact she doesn't even know that I'm asking about this on here and I haven't told her so she won't get upset. I have been checking her visa status on the ceac website and the status has been saying refused. I have done some research on this and it used to say administrative processing but I heard they stopped doing that. I have also read that the applicant should not panic or be concerned and the status would change to issu d after the documents requested had been approved. I am assuming that others are going through this as well and I am wondering if anyone has been changed to issued after the status had said refused. I am thinking that this is causing a lot of confusion and cencern. But it hasn't been 2 weeks yet. I am hoping to hear from anyone else who is going through this or recently has been through it.

Timeline

The status will change to "Issued" after the interview, all requested documents are received and approved, any background checks are completed, administrative processing is done, and all final checks have been completed.  Patience is still the key.  Good luck. 

 

This is a common issue......consulate slow speed.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I realize that others are probably in the same boat but I wanted to say something in case something might be going on that I might not be aware of. My Filipina fiancee had her k1 visa interview back in April 7 of this year. Although she passed her interview, she was asked to submit an updated nbi and police clearance which she has already taken care of weeks ago. The status has been saying refused for almost over a month now and it hasn't been updated since April 27. I am wondering if the recent election going on in the Philippines might have something to do with the delay in processing or is something else going on. My fiancee is concerned but I keep telling her that it is a slow process and we just have to wait. Does anyone know what might going on with the US consulate in the Philippines to delay visa processing? I really didn't think it would actually take this long.

Timeline

When did they receive the NBI and police clearance?  When a K-1 says refused, they have been refused a visa and file is returned to NVC.  Email the consulate and ask for a copy of the letter for the refusal of issuance of visa.

no. refused = administrative processing. OP can read the description in CEAC to see that.

what you are referring to is denied, which is very different...

That is why I asked when police clearance was received.  K-1 Admin codes at CEAC are different than for CR-1. K-1 will never say denied, it will say Refused.  

 

They were using Refused heavily for K-1 cases during the pandemic to hold them open by stating AP to prevent them from being administratively closed.

There's a separate status for "returned to nvc" so it is still undergoing admin processing most likely if they did not return the passport.

In the Philippines 4 to 6 weeks after your resubmitted an updated NBI Clearance would probably be typical.  Longer than that might be atypical but not unheard of. As long as everything else went well and you have given them exactly whatever they ask for, there is probably no cause for concern.  One of those moments where patience is required.  I don’t think the election would have anything at all to do with it.  It's just how long they take.

Is anyone else having issues attempting to check their visa status on ceac? I was checking on the status of my filipina fiancee k1 visa status but today everytime I  enter the security code it just starts buffering or something and it won't go any further. I have tried several times and was trying to find out if the website is down but I haven't found anything out. I am hoping someone might know what is going on.

I tried the clearing of the cache and it appears that it might have worked. It still buffers but only for a few seconds. Also, while I am logged on here, my ceac status has finally changed from refused to application received. It states to check back in 2 business days and I guess it will say what the next step will be. Am I safe to assume that this is good news for my Filipina fiancee and myself? I didn't want to create another topic and have a duplicate post so I thought I should bring this up on this thread. I am hoping again that someone will be able to let me know what application received means on the ceac status. She has already had her k1 visa interview over a month ago.
