They don't care (about us)

This is more to vent, so mods please feel free to move elsewhere you feel more appropriate. 

 

My fiancee just got denied B2 visa. Not that I put a lot of hope on this, but in the end it still feels so sad, that they don't care about us, at all.

 

We know each other 4 years ago, online, via a forum (fun fact: in her B2 interview, they asked how we met and my fiancee stated exactly this and I feel like that sealed her B2 denial). Started talking seriously later to know each other. Then Covid hit and we were not able to see each other until late 2021, when I decided to come back home again in the middle of the lock down. Ticket was super expensive, and I got to quarantine for a week in a camp. But we were desperate, it was needed for us to make the final decision about our relationship. After spending a month living together, we decided to file for K1 late October. With this processing pace, the best scenario is we get NOA2 around the end of this year. Then may be another 6 months until she get the K1 visa. That would be 4.5 years of long distance relationship.

 

We all know how hard long distance relationship is and I won't put more words on that. But they just don't care about that. We just want to keep our relationship alive. I can come to visit my fiancee once a year, I know lots of you are not that lucky. I can't do more often than that, I have work, I have a 6 year old daughter that I share custody with my ex. Why can't our fiancees visit us if they can afford more time? I joked to my fiancee that she can tell consulate officers that we have the strongest K1 case on earth that we won't risk it with AOS or any kind of visa fraud. Of course she didn't have chance to say that, but they wouldn't care anyway. Not to mention about our, I mean all of us here, future plans. I am sure we all are eager to start a family, to have kids.

 

Our emotional needs are totally ignored.

first of all, so sorry that you’re in this situation. Just know that you’re not alone and that there are a lot of people experiencing the same.

It would be very helpful if you completed your timeline. If you do so, people from the same countries can give you a better insight of what’s going on. VJ is a great community. 
Where is fiancé from? 
what was the reason for the denial?

any red flags? (Big age gap, different languages, no job in home country) etc

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

So many factors go into the B2 denial. 

People from your fiancee's country overstay their visa. People from your fiancee's country visit on a B2 and then adjust because they didn't want to stay separated from their loved one for so long (and consular process). 

It is extremely unfair that regular people who have no intention of overstaying, no intention of adjusting are denied the opportunity to visit because of the actions of others. 

It is also wild when a USC's partner isn't allowed to visit the US even though the USC lives and works abroad! 

It would be great if everyone was given the opportunity to visit the US before moving there. But, unfortunately because adjustment is allowed from tourist, work and student visas COs have to determine if an applicant is at risk of overstaying/adjusting... 

I'm so sorry your partner is able to visit the US while you wait out the process. And I hope processing times for K1s speed up.

Certainly not an outlier, my now wife was denied a B2 twice in 2012 and 2013 for what we believe was essentially profiling relative to middle aged women from Eastern Europe being a poor candidate for a B2 regardless of how strong their ties are.  It is tough, and after the last denial my wife was crying on the phone after having traveled 2 days by train for a 5 minute interview that ended in denial.  Of course Covid was not around back then, so I traveled to visit her, and after we decided on the K1 route, I did everything I could to prepare her for the shock of moving halfway around the world.  Giving her virtual tours of what would become her new home, having video chats with my family and friends so she could meet them at least over Skype, etc.  It can be tough, but immigration requires patience.
