Does a child age 9 go through the same process of an adult immigrating to the U.S. and what is the timeline for a child estimate of course. We :wacko:went DCF for my wife and at that time my stepdaughter did not have a passport and Belize did not have a working Passport machine now that she has her passport we are eager to get her here with us. She is staying with my mother in law who is having surgery soon and we need to get her here immediately is it possible to file paperwork for expedited visa. :help:

There is no expedited service available for her. You would file a I-130 petition, and then with NOA1 you could file the I-129f petition for a K4 visa for her. She would also have to adjust status after entering the US. The process will take longer than your wife's DCF process as you'll be going through a US service center this time.

I don't know the details on this, but if her father still has some type of custody, he will also have to be involved at some point.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

A K4 is a derivitive visa. The child cannot come on a K4 visa if the parent never had a K3 visa. DCF petitions do not result in K3 visas.

One thing you will need at interview time is clear evidence of the mother's sole custody or an official documentation that the father has given permission for the child to immigrate. (Or a death certificate for the father.)

Get the local court to grant sole custody to the mother. This would be a legal process done in her country. The mother may need to return to he country to accomplish this. There is no way around showing full custody or permission. You can't get permission, so if the father is on the birth certificate and you have no death certificate for him, you need custody granted to the mother.

I realised DCF wasn't an option. I didn't know that a K4 visa wasn't possible when done separate from the K3 - thanks for the info.

The problem with that is now I am sick I have MS and we have our other children to worry about is there not another way?

A visa is required to immigrate to the USA. There is only immigrant visa process.
