I-864 AoS accepted (asset only), but review note for financial evidence, not sure what to do...

Did you get an RFE message requesting the proof of income document? You then submitted it and never got a DQ email? But got an interview date anyway?

That is correct. Like I stated I think the proof of income was a flub, but still i got zero information back on it. When I asked to expedite cause the actually approval form CEAC was just taking to long, they approve to expedite. My wife interview and they have taken her docs, but they said we need to submit update 1040 and W2 of mines or affidavit ( I think its really on the affidavit cause I don’t need to claim my Japan income. I filled my 1040 as unemployed)

How long did the approval take for you when you sent the request to expedite? I am wondering if I could do the same thing and expedite the process, stating that our children already have a spot in schools and we will probably loose them if we don't manage to be there on time.. Did you mention the "silliness" of the RFE that you got in the request?

@adventures Have you submitted the document they requested under PROOF OF EMPLOYMENT yet? I´m trying to convince my lawyer that we don´t need a joint sponsor and to just submit the evidence of income they requested.

 

I´ve seen a few recent cases of people who got RFEs and then DQs a few days after submitting the requested evidence so maybe we dont go to the back of the line after all. Fingers crossed.

Yes!  we did :) in Fact. Just to be sure we submitted several more documents. I submitted every document with a comment that we only do this for the RFE, but think that it isn't relevant for the case itself due to our asset only approach. Hoping that this approach makes it easier to expedite the case.

 

So overall we submitted:

 

- Statement about evidence of income under "Proof of Work" and that we can not provide evidence for US-based income, but that we provide our foreign income even though we know that it doesn't matter and instead we are using our assets.

- 2 statements, that we also can not provide W2 or 1099 Forms  under the respective labels (We don't need these as we're not filing jointly. But we read in other threads that they wanted this.. so now we just want to  be 100% sure we don't get another RFE)

- Uploaded past job confirmations under "proof of work" and bank statements for the income (all based in Germany, so for the interview they won't play any role at all...)

- Uploaded a updated Bank Statement about our assets, as we are in the process of moving them to the US and also mention this in the statement about evidence of income. We thought it might help..

 

We think that probably just the statement for "evidence of income" uploaded under proof of work would have been enough. But we thought that as we're probably resetting the waiting clock we could upload the other things as well just to be sure.

 

Next thing we are going to try now is submitting a request to expedite our document approval. Maybe this will work in Germany and with a little bit of luck it'll speed things up. We are on a tight schedule where children need to go to schools they have already been  approved to at end of August... Maybe the fact, that this still seems to be like an error from NVC + the school thing will convince them to speed things up a bit...

When did you submit everything? I´m watching your case closely since I´m in a very similar boat.

Frankfurt seems to be AMAZING when it comes to processing immigrant visas and super speedy. So, for your sake I hope your expedite is approved.

Our Status for AoS now reads: "Paid, Accepted". So We are not sure how to interpret the review notes now.. 

 

  • Is submitting the above (income or/and joint sponsor) still optional and we can just wait until the DS-260 is accepted as well to get an interview appointment?
  • Do we HAVE to submit anything now in order to proceed? As we don't have a US based income (yet), we cannot submit anything regarding note2 ...
  • Would submitting a Joint Sponsor delay the case or help? Would we simply bring a completed form to the interview or do they want you to submit it online first?
  • Should we bring a completed joint sponsor application to the interview "just in case"?

 

I have read in the following thread that this seems to be normal. But I am not sure if this still applies to us as well. Our interview would be in Germany.

 

 

I wish you the absolute best of luck with using the asset only approach, but I'd have a Plan B if I were you. I live in Peru with my wife, I have income here that will continue in the US, I also have comfortable assets over 3X (even comfortable over 5x) and all as liquid as you can get. He still gave us a 221g for a joint sponsor.

Did you get DQd from NVC and then had the visa refused during the interview in Peru? What happens now for your case? Did you already submit the joint sponsor information? Whats the timeline like now?

 

One more question, are your assets US based?

One more question, are your assets US based?

-Yes, DQ'd February 9, 2021

-Waited 2 years + for interview (+ roughly $2000)

-Interview March 31, 2022

-Wife afforded a 3 minute interview - Refused - 221g for joint sponsor - she mentioned assets but according to CO "assets are too complicated" (she told me they were handing out those green slips like candy btw) asked for her passport and canceled her tourist visa.

-Submitted joint sponsor information April 10, 2022, CEAC updated yesterday, still says Refused

-Yes, all assets are US based, largest being a savings account....not much more liquidity than that...

 

I do want to add though, every embassy is different, every CO is different. It's not really fair, but that is the way it is I guess.

 

Oh, and the timeline now is anybody's guess: weeks, months, have to do another ridiculous medical? Who knows?

Wow, that´s unbelievable man. Sorry that you had to go through that. Hopefully the joint sponsor submission will take care of the problem but this process can be incredibly frustrating sometimes...

Only the new documents are are shown as "Submitted", the old ones remain "Approved". Did for some poeple everything go back to "Submitted"?

No idea, I was just curious.

 

I hope you get DQd soon instead of going to the back of line (fingers crossed). Please keep us posted.

If I recall correctly, I got the nditification within a week of putting the request in.
