I-864 AoS accepted (asset only), but review note for financial evidence, not sure what to do...

From @adventures reply and reading through https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-5-collect-financial-evidence-and-other-supporting-documents.html it looks like that might be the key to getting DQed with assets. Some type of statement under the "proof of current or self/employment" category. I just noticed that my letter explaning my lack of income was uploaded under the "FORM W-2 WAGE AND TAX STATEMENT" document category. Im on hold right now with the NVC, lets see what they say about my case.

Well "great" is open to interpretation... they said the waiting clock will likely be reset for us. We called this number:  (603) 334-0700. Which you can find here:

waiting time was approx. 2 hours. We called them about 1min. after they opened.

Thanks, thats the number I called. Just wanted to make sure because last time I tried calling they couldn´t even put me on hold for some reason. 2 hours wait time is rough, I´m on hold right now...

 

It´s insane that you go to the back of the line for something like this... and the worst part is not even being sure that you wil be DQed. What if there is something else they want next time? It´s messed up.

We uploaded a work contract under "proof of employment"... as another member @Ashley Wallace was asked to provide proof of income and uploaded a pay stub even though the income would not continue after the move to the US.

This is all so annoying. I wish they would be clear about their requirements. Indicate all the different categories that are needed... but give the instruction "upload a statement if you don't have the required documentation..."

Maybe this was less of a problem when review times were just 30 days. Now that we are at almost 3 months it´s just depressing. Anyway, let´s just hope for the best going forward...

Can you give us some hints what that statement looks like for you? Do you have any source fomr other forum threads giving hints on how they wrote a statement and it worked?

 

Right now I am thinking we would basically write and upload a signed letter along the lines of:

 

"

In this letter I provide an explanation for why I cannot provide evidence of income or employment as required by the Case FE Review note from 12-Apr-2022.

 

I have not worked in the United States since 2008 and therefore cannot provide a W2 or other proof of US-based income.

 

We have enough assets without current US-based income to support our case. Additionally we provided the IRS tax return transcripts which also show that we do not have a US-based income in the last several years. We are aware that the final decision is to be made by the consular office in Germany.

"

 

 

- Additionally, should we provide some evidence for the foreign income which is mentioned in the tax return transcripts, even though it doesn't count and is labeled as  foreign income anyways?

I just wrote something that I thought sounded good and had my husband read it over...

I just got off the phone with NVC and I am convinced that we are just stuck in red tape. It looks like anytime your current income listed on the I864 is below the poverty guidelines, you need to upload something under the PROOF OF CURRENT OR SELF EMPLOYMENT document category. It seems like this is almost part of a checklist they go through.

 

The NVC lady told me that they dont even look at assets, only the embassy evaluates that documentation. Basically, the NVC only does clerical work. You just need to upload documents under the right catergories to get DQed.

 

She also confirmed that we go the back of the line... F me.

Yeah.. I am so sorry for you and us 😥  I guess we'll now provide multiple statements for all possible cases and additionally provide proof of income for foreign based income & jobs. This is just ridiculous. Doing all of this while it doesn't matter anyways, as we're using our assets. I'll keep posting here about our progress on this..

Are you talking about the proof of employment document? Did you upload something for that category for your original submission and got DQed or did you upload it after an RFE?

I thought you said you already went through your interview. A DQ email is typically sent by NVC before you're interview can be scheduled so now I'm a bit confused.

 

Did you get an RFE message requesting the proof of income document? You then submitted it and never got a DQ email? But got an interview date anyway?
