GC date: 07/10

N400 date: 04/11 8am online

I've been reading multiple posts on n400 denied for applying one day too early

04/11 is the earliest accepted filing date for me,

I started filling out forms on 04/10,  the online filing system won't allow me to submit on daytime because of the 90 day rule, but around 11pm, the warning disappeared and it appeared that I can submit the form. I waited the next day morning to submit it to be safe.

But the posts on denials make me feel worried about whether I did it too early, I should have waited one more day...

Just curious, it's e-filing, they've built an online system and apparently they intend not to let you submit before 90 days, but there's a window of hours, probably time zone issue, that you can submit before 90 day rules.

If that's an unintentional bug in their code, it has surely generated some revenue for them already, if it's intentional, hmm....

Why do people insist on filing the very second they become eligible?  Filing a few days after the window opens causes no delay in processing.  All you can do is wait.......

Say it louder 🗣 @Crazy Cat

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Because it’s their right.

Similarly why do people insist on filing N-400 online when the system has proven to be riddled with software bugs: allowing filing before day 90, changing answers on questions, recording the wrong date of filing to name a few?

Answer: because it is convenient.

We will be filing early morning day 90, by usps priority mail.  The package might get to Phoenix the same day as we expect to be living near there by then.  And we have zero worries about being dinged for early filing.

We are more worried about the interview being scheduled before the 3 year anniversary and we have a plan to deal with it.

Case in point today:

When you can’t even get a reliable and verifiable record of what should be legal document submission why would you surrender your rights to an appeal using it? It’s just trash.

I'll paste here part of a comment I did in another thread about this subject:

I started my application before the legibility (before 90 days to the 3 years), just so I had everything there and ready before sending. So I put a fake date (for purpose of being able to start filling, then correcting it before sending the petition, of course) as my "date that became a permanent resident" (or however that question was worded). One thing I noticed was, depending on the date, it would show me the option to upload taxes and marriage certificate, but not the spouse proof of US citizenship and proof of relationship.
- When I put a date that was exactly 90 days from the 3 year mark, I could fill, it would recognize my marriage based eligibility, but it would not show me the questions to upload spouse proof of US citizenship and proof of relationship;

- When I put a date that was more than 90 days to the 3 year mark, it would complain that I am not eligible

- When I put a date that was 89 days to the 3 year mark, I would have all the upload options (spouse proof of US citizenship and proof of relationship)

So, even though it recognizes you are eligible when filling at 90 days mark, it seems suspicious that there are things that change in the petition. Therefore, I sent with 89 days to avoid this suspicious situation and don't get caught in a technicality or whatever that is.

Not every right is worth the trouble to exercise.

Just another random guy from the internet with an opinion, although usually backed by data!

Hi Mike,

I'm wondering if you could share your action plan if the interview is scheduled before the 3 year anniversary. I also applied under the 3 years - 90 days rule and reading the new/odd developments regarding early filings starts worrying me.  My case has been moving pretty fast so far.  Is this even an option to request an interview rescheduled to a later date?

Many thanks!

We intend to bring an experienced, licensed, AILA-listed attorney with us,  preferably one who can quote chapter and verse from the USCIS policy manual and INA, and has experience moving cases to federal court jurisdiction.
