Dual Citizenship for newborn - US Citizen & Canadian Citizen parents

Hello,

 

I've tried contacting USCIS, Googling, Social Security (hospital told me to try SS) and I'm not getting a definitive answer so I'm hoping someone here can help me out. 

 

To start, I am a US citizen and my husband is a Canadian citizen. July 2019 my husband came to VA on a K1-Visa. As of February 2022, he is in the process of removing the conditions on his greencard as well. We are expecting our first child in mid May. I've been trying to figure out if our son will have dual citizenship automatically or if there is paperwork involved but I can not find an answer to my questions. When I Googled, I didn't really find what I was looking for, just that US allows dual citizenship.. When I called SS, they told me to contact USCIS. So I tried calling USCIS but the damn automated lady can't answer my question and won't allow me to speak with a rep. She literally said "If you continue asking to speak to a representative, I will have to disconnect the call." I didn't even know machines could do that but that is why I'm here asking. Any insight on this would be so helpful! If it's paperwork involved, I'd like to have it as ready as can be for when he is born.

i think you should ask canadian embassy no? i dont think its US issue, if you give birth in the states, ur child definitely is going to be USC. now what paperwork does canadian side wants?  if u want to call uscis just say "info pass" or "live agent"

Timeline

This process is not something that can be applied for but that happens when a person becomes a citizen of another country, in addition to his/her country of birth. Certain individuals get multiple citizenship automatically. For example, a child born in the US to foreign parents gets dual citizenship as it is automatically a citizen of the US and also a citizen of its parent’s home country. This also applies to children of US citizens born abroad where the child is both a US citizen and a citizen of the country of birth

The USA government has no authority to determine if your child has Canadian citizenship. This was settled in the war of 1812. 😂

Was your husband

 

1. born in a Canada 

 

2. born elsewhere but naturalized in Canada, or

 

3. born elsewhere but was a Canadian citizen from birth

If 1 or 2, your child will also be a citizen of Canada.

in addition as per the 14th amendment, all children born in the USA,  except for children of diplomats; are USA citizens. 
 

As far as the process goes, no hurry to get your child a Canadian certificate of citizenship unless the child plans to live in Canada. Every few years I see if the process gets simpler, and after 30 years it is simple enough that I am going to get my kids their CCoCs this year.

I haven't done it for my 2 that were born here in AR. Did it get easier? I looked at it about 10yrs ago but not since.

USA residents can now do it all by mail and potentially completely digitally.  And USA residents  bypass the Canadian consulate

Timeline

If your husband is Canadian, you can file the paperwork with the supporting information and get a certificate of Canadian citizenship for your child.  This process is currently taking no less than 18mo, so don't be shocked if you send it away and hear nothing.  Once you get the certificate, you can then get a passport for that kiddo and that kiddo will be eligible for Canadian tuition rates once you get that far down the road for uni.  (yes, it sounds like a long time, but it's not once your baby is born!)

 

Be aware that any grandbabies you might have will NOT be eligible for Canadian citizenship through your child unless that grandchild is born in Canada.  If you'd have had the baby in Canada, that'd be different.
