Hello Everyone,

It feels like yesterday while I was on the page when I was filing my GC and now it's already time to work on my ROC. Hope everyone's doing good.  

Here's my update until now. My GC expires on August 17, 2019 and on April 02, 2019 I received the form i-797 C Notice of Action from USCIS reminding me to apply for the ROC. I am already working on form I-751 and preparing all the required documents.   

Now, my question is can I file my I-751 this week (by May 17th) or should I need to wait until May 17th to reach my 90 day period and then file the form I-751?

You must wait until 90 days in prior to your GC expiration date, but when you are filling out I 751, it could be earlier than the 90 day windows. 

If your 90 days is open starting on May 17th, you can complete all your paperworks by May 16th and ship it to your lockbox delivered by 17th, and no problem, your application will be accepted. 

However, if your delivery is completed by 16th (1 day prior to 90 days window open), your I 751 will be rejected. 

 

Most people file as early as possible since ROC is painfully long process as soon as window is open. So you might wanna file it soon

Like xillini said, do NOT send it too early or they will reject it. I waited a couple of days into my 90 day window partly for that reason, to make sure my petition would be safe. 

 

If delivery is too early, even by just one single day, they will reject it. There's no reason to file early, it's not a negative thing to wait a couple of extra days after your window has opened.

Personally, I would wait until the 90 day window opened, then send it USPS Priority Mail.......it will then be delivered (usually) within 2 days......I've seen several people lately who have had their packages returned for filing early.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hi all, our 90 day window opens May 13. I'll post our some cover letter here (personal details redacted) in case anyone has any suggestions before we send or this can help anyone. A helpful post when deciding which evidence to include is also below. Good luck everyone!

Please find appended Form I-751 and materials to support removal of conditions on residence for [Conditional Resident Spouse name (CRS)]. USCIS granted CRS conditional permanent residence on Aug 11, 2017.

Apr 16, 2021:  Interview in Portland, OR. Refused entry to USCIS office due to have traveled abroad in the past 10 days. No interview. However, a few hours after refusal, received notice of approval and card produced!  

Apr 20, 2021:  Card mailed! "On April 20, 2021, we mailed your new card for your Form I751, PETITION TO REMOVE CONDITIONS ON RESIDENCE"

My window actually opened up in February and I didn't get my packet to USCIS until May.  Took me a bit longer to get everything together than I though it would.  The key is don't file too early or too late (you'll need write a letter of lateness letter), but hit the sweet spot and you'll be good to go.

Hello everyone!   Filed may 3rd.  Received the NOA today, form 797.   So now I guess we play the USCIS waiting game all over again!  Lol!

One more couple joining the party. 

 

We filed for ROC today, May 11th, our window opened May 1st. 

 

We used USPS priority and the lady said it will get there on Monday. 

 

We never received a reminder to file, is that normal?  ( I was initially issued a 10 years GC and submitted i-90 to replace it) also when I went to USCIS infopass to get a stamp the officer said my status still shows as non conditional) Hope their system is up to date by now, but please let us know if it is normal not receiving a reminder.
