AOS (family-based) Cover Letter Review

Hi all,

 

Would love to get a review of the cover letter and packet contents for my husband and I. I am the US citizen, he is French adjusting from F1 OPT. We will be filing I-130 online and mailing the rest. My employer switched their HR company halfway through the year so I have 2 W2s, but they are for the same employment I have held for 1.5 years. I easily met the support level for 2021, but received a raise for year 2022 which is why I am including the compensation letter since that is my stated annual income on the I-864.

2. Form G-1450 authorizing a credit card payment of $1,225 (To pay for filing of Form I-485 which costs $1,140, AND biometrics which are $85)

3. Beneficiary’s Form I-485 and supporting documents

3a. Copy of the Beneficiary’s passport

3b. Copy of I-94 Arrival/Departure Record of Beneficiary

3c. The birth certificate of the Beneficiary in French and an English translation for it

3d. Certified copy of U.S. Marriage Certificate of the Petitioner and Beneficiary

3e. 2 Passport-style photographs of the Beneficiary

4. Petitioner’s Form I-864 and supporting documents

4a. Copy of Petitioner’s passport page

4b. Petitioner's 2021 Federal tax return

4c. Form 8453

4d. 1099 from Company 1

4e. 1099 from Company 2

4f. 1099 from Company 3

4g. W2 from Employment 1 for 2021

4h. W2 from Employment 2 for 2021

4i. 1099-INT from Company 4

4j. Compensation letter from employer showing increase in income effective 01/01/2022

Form I-693 will be submitted at the interview or in an RFE as necessary

 

All copies of documents submitted are exact photocopies of unaltered documents. I understand that we may have to submit original documents to an Immigration officer at a later date. If you have any concerns or questions, please call me at xxx

Much better if you just send the IRS transcript. Less paperwork, much easier to understand.

Timeline

1. I would just file everything on paper, even the I-130.

2. Use a Money Order. I always recommend that because you never know. USCIS might reject your CC or it gets lost and your package is sent back and you're back to square 1.

3. I would suggest do the medical now and submit it. Submitting g it now helps your avoid delays at interview. Here is a list of cheap doctors

4. Remember, evidences should satisfy each form. So, make sure you have all the 8 PP pictures, not just 2.

As such, I'd recommend breaking your cover letter to note each form and their subsequent evidence underneath. That helps makes sure you satisfy each form. 

 

There's a guide on top right of the forum. It details requirement for each form

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

The IRS transcript for wages and income won't be complete until July. I could do the one for my 2021 return as that is there, but I still have to include my W2s anyways according to the I-864 correct?

We decided to go with I-130 online since it ensures we can't miss any boxes and has an immediate receipt. I understand it's nice to have everything together, but the immediate receipt was the deciding factor for me on that one.

Will switch to a Money Order.

We want to submit in the next few days and we were waiting to get him on my health insurance for vaccinations and everything, so medical will be done after submitting unfortunately.

No. As per page 8 instructions

No, I filed in February. My tax return transcript is available. I was wondering if I also needed the "wage and income" transcript as well and that one says they aren't available until mid-July.

 

Thanks! That does get rid of a lot of confusion in the application being able to use that instead.

No. If you sign up for an IRS account, you'll be able to download the transcripts. It is going to ask you for the reason, you select "immigration" and it will make the needed transcript available. I have seen RFEs for people that send the tax return documents, and it seems that sometimes officers do not know how to "read" these.

The link that I sent for doctors is cheap..My friends have done full medical for $320..Results come in a week. 

 

But upto you.
