Timeline

Hello to everyone, 

Dear friends can you tell me. Our accountant filed my wife taxes as Single. Accountant said you don't have SSN and ITIN. We apply for ITIN IRS didn't issue ITIN number. Guys what do now. We submit to embassy taxes return papers soon. Suggest me what I should do now. Accountant said you can't file as married because don't have SSN and ITIN.

Married is married.  The accountant is wrong.  You cannot legally file as single if you are married.  You can make him/her file a 1040X to amend the filing status if you want.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Ask the account is he/she knows what "Married- Filing Separately"  means......

Accountant is wrong 

when married u file as married

when spouse is nonresident you file W7 with the supporting evidence (marriage certificate always and it has to be original with English translation) plus photo proof of ID

 

open this site ,  print out the page and make the accountant redo taxes with a 1040X 

and don't pay him for this

That account is said you don't have any SSN and ITIN. Last time my wife file taxes from another account he filed married filling Sperately.

Guys, can you tell me how much take time get amend 1040x and transcript

Don't worry for now, no need to amend at this time. Your wife's tax return filing as single is an IRS issue, doesn't impact your visa processing. All the embassy wants to see is the petitioner is paying taxes lawfully.

 

It would take almost 3-4 months or more during these time for the 1040x to be processed. When you immigrate to the US and get SSN, then amend it to married filing jointly if that gives you tax benefits. For now just relax.

I really so worried about my wife taxes. I keep international calling our accountant about taxes. Accountant said, can't file married until you present in USA get have SSN and ITIN. Really crying now 😭 about this situation

It doesn't matter whether it says single or married on the tax return for your visa processing, why to waste tears on something not important. Just relax.

My wife transcripts will come her mail box next 3 or 4 days. Then I submit those to embassy

She could have just emailed you the transcripts for you to print there.

She send me signed affidavit of support and employment paychecks and employer letter and transcripts via FedEx to Pakistan. Just was worried about her 2021 transcript as a single status

read what the IRS site says

 

If, at the end of your tax year, you are married and one spouse is a U.S. citizen or a U.S. resident within the meaning of Internal Revenue Code (IRC) section 7701(b)(1)(A) and the other is not, you can choose to treat the nonresident spouse as a U.S. resident for tax purposes

 

accountant is wrong

i filed for ITIN with 2010 tax returns as married that year

and used the ITIN for 4 years as Adil didn't have his visa till 2015

 

u don't need amended return for the intervview but your wife should start the amendment as it takes months 

 

just be sure your joint sponsor has furnished her with completed forms and tax trancripts

Married people filing taxes as single are not lawfully paying taxes.  This is tax evasion.

We amend it soon as possible. We submit embassy 1040X with current 2021 transcript is it good or not. In few days we got our 2021 tax return. Our new accountant is said he will amend it submit 1040-X to IRS and take 2-4 months get processed. Embassy time also over next month. Should be enough amendment form which we'll send IRS in few days.
