Hello Everyone,

 

We finically received a bios appointment letter 13 months after we applied for AOS. PD is March 3, 2021. The I-130 was approved August 2021 then nothing. We applied for both 131 and 765. I've seen where others had their bios taken 2-3 months after submission. We requested expedite for the 765 since it was out of the normal processing time. Service center is Nation Benefits Center. We contacted our senator because we felt USCIS is unfair since we know others that applied 4 months after us that just received their GC with no expedition. We let our senator know that's as well because they say they process in order but that's obviously not true. We received a bios appointment letter this past Saturday for April 26. 797 Notice date says April 1 which was before we contacted our Senator. We just received another notice today but it wasn't a 797 notice, it was a letter with a status update and a different bios appointment date for 1 day earlier on April 25. We noticed our Senator sent them our complaint on April 5th and the letter we received today is dated for April 6 (a day after). The letter said "our records show you need to appear for Biometrics collection. Your cases are suspended or on hold until we collect your Biometrics. After we collect your Biometrics you can re-submit for expedition". Our expedite request was for the 765 due to "severe financial loss".

 

Also note that first bios appointment letter had code 2 on it and only listed my application for 765. Second letter we received today has code 3 on it and lists both my 485 and 765 cases. 

 

I'm worried that completely skipped over our case and now will only begin to process the AOS and we have to wait another year.  Both 131 and 765 are 1 month out of normal processing time. Has anyone else received their bios appointment a year later? So far it seems like only our case. 

 

Do we have to expedite again?

I'm sorry to hear that! I got my bio appointment about 1 month later after I filed. I am still waiting for my AOS interview (although I got my EAD and AP approved already via expedite help from my senator). 

 

Please note that your member of congress can only advocate on your behalf. They cannot influence the decision of USCIS even if you think it is unfair. For your I-485, I don't think they skipped over your case. It is a matter of luck or waiting game. For example in my case, many in July 2021 filers are already approved and I am still waiting after 9 months. I am still within processing time for up to 2 years based on my field office.
