Annulment of marriage after VAWA was Approved 

 

What is the effect of marriage annulment on citizenship? My i360 (VAWA) has been approved and I am looking forward to my GC. My abuser want to have marriage annulment instead of divorce. Can this affect my GC or Citizenship in nearest future? Experienced people should pls advise.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Assuming your spouse wants to file for annulment and is claiming fraud. In your state (NJ) a quick read on internet info says there will need to be a hearing , so you have a chance to dispute the allegations he is making and make an argument that he waived the “ fraud “ because so much time has passed. Definitely contest it. 
Your green card ( LPR) is safe w the approved I-360 , but rocky road for N-400 and any other immigration benefits you may consider in the future ( like filing an I-130 for other family members of your own) 

 

There is a VAWA group on VJ and I am sure you will get much info on others experience. Hopefully you get lots of responses, remember it’s DIY and you can listen only to the ones you like! Good luck

Why do you care what your abuser does or doesn't want? You do what you want and what is best for YOU.

Your immigration path will be based on the approved I-360 and not your marriage. Annulment or divorce, it’s termination of the marriage and it won’t reverse the I-360 decision or your GC approval.

I know of the case similar to yours. There was a family court decision of annulment on the grounds of fraud. By then there also was an approval of I -360. And a successful GC later. Do not worry, abusers often seek revenge claiming immigration fraud. Good luck!
