USC filing for Canadian Spouse - class of admission and domicile questions

NVC Received: September 13th 2019

NVC Docs Uploaded: October 29th 2019

Visa Received: November 5th 2020

Read this thread.

You might be able to avoid separation. You might not. 

As you haven't submitted the I-130 yet you're looking at 6-12 months before you hit NVC stage. 

Then another 2-3 months at NVC before you get into the line for interview.  So, in theory you won't have to leave your partner for at least another year. 

Some USCs move back to the US about 2 weeks before interview and that satisfies the CO. Others move back a few months before interview. 

 

Be aware if the CO issue an 221G for domicile it will take about 6-8 weeks before they reply to your additional evidence submission. Montreal can be very slow.

Dad is "Joint Sponsor". If he's married, provide an I-864a from his spouse.  What about the kid's new US school?  Looks good though, and of course you can continue to visit.

Facts are cheap...knowing how to use them is precious...

You've go a ways to go yet.  I wouldn't panic about domicile yet.
