Hello 

 

Here in the full image : we got DQ last month and NVC accepted all our docs ( we are using the 2020 tax docs and I864)

 

1 *do we need to submit / bring new I864 to the interview ( with the 2021 tax retun info + 2022 current income proof) .

 

2 * If the tax return of 2021 shows that my husband doesnt meet the required income ( since the guidelines were changed ) , we should find a joint sponsor ( btw  my husband 2020 income on his tax return was above the limit and his docs were accpeted ) ?

 

3 * Does the CO will ask the paper were accpeted by NVC or we need to submit again everything with 2021 infos ?

1.  I would take an update I-864 , 2021 tax documents, and current income evidence to the interview.

2.  No.  CURRENT annual income is king.  If his current annual income is sufficient, no need for a joint sponsor.  (CURRENT annual income = latest gross pay period income X number of pay periods per year).

3.  If the interview is after April 18th, the CO can ask for 2021 tax documents.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks my husband is a business owner so its hard to show his current income  !!

If he filed 2021 taxes, I would be prepared to use those as an indication of income.

If in doubt, get a well-qualified joint sponsor.  Be ready to submit the joint sponsor's tax documents and proof of current annual income at the interview. 

You can even upload the joint sponsor documents to the CEAC site now.

A member from Japan was just asked for updated W2s/1040s from their joint sponsor so anything can happen during this time. 

If you can line up an updated I864 and sponsor before interview I would do so...

You don't have to give them during interview but if they request you'll have it on hand. 

 

ETA Please updated your profile and add where you are interviewing/ beneficiary's country and then write up a post after interview so others from the same consulate can prepare for any and all eventualities.

Absolutely not.  For the self employed, only a tax return can be used as evidence of current income.  Don't confuse revenue with income.  His "deposits" are "revenue".  Income is revenue minus expenses.

Yes.  

A business owner can use business bank statements to show his gross revenue but must also submit a Profit and Loss Statement for the bank statement period in order for him to claim a “ Current Income” , which in many cases may be different than the previous years tax return. 
Think of a P/L as the “ current paystub “ of a W-2 employee. Large corp/ businesses uses CPA s but there is nothing prohibiting a DIY..

I'm sorry, but no.  The self employed can only use a tax return as evidence of current income.  Business owner does not necessarily mean self employed for tax purposes.  A business owner can be an employee of a company they own.  That's not self employed.  Without knowing more about how the business is organized, my answers focus on "self employed".  If more information surfaces as to the actual circumstances, that advice may change.  If the business owner is employed, the current income is evidenced by a pay stub, just like any other employee.

Facts are cheap...knowing how to use them is precious...

So, he is probably an employee, but it depends on which class of corporation.
