MY Fiancé and I had applied for a K-1 fiancé visa. We already had our interview and fiance was found inadmissable due to class A finding, we were told we must wait a year and then can request another medical exam.

Initially we were told he can't apply for B2 visa because the embassy was not process that type due to covid. Now I see the Dominican embassy is taking B1

visa appointments.

1. I am wondering how long I might expect for this process?

2.  Total cost for this type of visa?

3. I have already paid a fee for DS-160.... I have the confirmation but on it it says that the motive of the trip is : K1 fiance visa.... however now i would be applying for a new type (b2 tourist visa) so he can come visit while we continue to wait for our fiance visa...... do i need to pay for another DS confirmation.

What steps should I take to start this application process?

You going waste your money,  I applied 2 times for b2 visa and was denied because first I had a k1 visa years before I applied for b2.

Think, how will get a b2 when he has immigrant intentions?, apply for a k1 mean he wants immigrate to usa.

Second he was found inadmissible on k1 so the same for b2

Class A and B conditions are defined in Department of Health and Human Services (HHS)regulations. [1]

Class A conditions are medical conditions that render a person inadmissible and ineligible for a visa or adjustment of status. [2] A Class A medical condition is a:

  • Communicable disease of public health significance per HHS regulation;

  • A failure to present documentation of having received vaccinations against vaccine-preventable diseases; [3]

  • Present or past physical or mental disorder with associated harmful behavior or harmful behavior that is likely to recur; and

  • Drug abuse or addiction.

All depends which of the 4 categories is your fiance, best you can do is get married and apply spouse visa. And be sure that your fiance anadmisibility is not related with drugs because will be difficult get approved in any kind of visa

A couple of hours ago you asked about “switching “ the K1 to CR1 visa. Now do you want to apply for B2.
I you will need to wait the time they told you and apply the correct way.

Or consider moving to the fiancee's country, as this will not be a quick fix.

The "DS-160 fee" you paid was for processing tbe K-1 visa application by the Embassy, including the interview.  The processing of that visa has already been done and the fee receipt is not valid for a new, different visa application. So, if you are planning to have him apply for a B1/B2 visa, you would need to pay a new MRV fee of $160.  However, I would advise you to save your money, as he is not eligible for a visa at this point.

More importantly, you need to focus on what you said in your second sentence: "...fiance was found inadmisdible...".  This means exactly what it says. Your fiance was found "inadmissible" to enter the United States. This means he cannot be admitted into the US under any visa category, not just the K-1, until he has overcome the ineligibility.  Overcoming it will take the year that you have been told.  Only after that year is up and he has a clear medical exam will he be considered eligible for possible entry into the US.

I don't see any way a CO would see an application for a B2 as anything other than an attempt to bypass the 12 month ban and get inside the US.  I think the chances of a B2 are less than 0%.  In fact, this could have even more ramifications if he misrepresents himself.

The chances are -0%, as explained before he is "inadmissible" regardless the type of visa, an alternative to be together is you moving there with him in the meantime. He has to wait 1 year to get medicals redone but of course they have to come "clean" to avoid the same result.

Good luck on your process.
