Posting from a throwaway account as I shared my last account with my husband.

 

So I am a UK citizen and married an American Citizen. To cut a long story short, we went through the IR1 process (we have been married for more than 2 years). I had my interview at the London embassy at the very end of March and I was approved for a 10 year greencard. 

 

I have sold most of my belongings (including my car), quit my job and did everything that I needed to do in order to prepare for my move to the states. Sadly I recently discovered that my husband has been using multiple dating apps and attempting to meet up with women. I confronted him about this and it is as if his mask has fallen off, he has become a completely different person- spiteful, bitter and angry. I feel so blindsided and heartbroken. I feel like the man I married does not even exist. He now wants to get a divorce which I will not be contesting.

I have a few questions that I am hoping you guys can help me answer as you are all so helpful and informative.

1) I have mentally and physically prepared myself to move to the states, if I still want to move, will there be any issues at the point of entry? Or will I not be allowed to go because my husband and I will be getting a divorce?

 

2) I have (obviously) not yet visited the states with my approval, can my husband cancel my greencard?

3) If I am able to go and 'activate' my greencard, I was planning on applying for a re entry permit to come back here to the UK and make sure I am fully ready to move. the re entry permit would buy me some time and extend the usual.6 month waiting period if I feel I need a few more months.

 

4) If I am granted a re-entry permit, could there be a possibility that I am denied entry based on the sole fact that I am no longer with my husband?

 

I apologise if this does not make sense. I have had little to no time to research any of this as I was completely blindsided by my situation. Any help would be greatly appreciated.

First I am very sorry you are going through this. 

 

Ok If your husband has not contacted the Consulate or CBP to tell them he is divorcing you and to cancel your visa. Then you can still us it.

 

There was another member on here who not only used his visa to get his 10yr card he also was able to naturalize at 5 yrs.

 

Since you're ready to go get on that plane and start your new life.

I am afraid my husband may try to cancel my greencard out of pure spite. How long would he have to cancel it?

Keep proofs u found for questions u may face later

Get your covid test done

pay the green card fee

and get on a plane

get the I 551 stamp on visa allowing u a green card and to work 

 

see i US lawyer and u file for divorce based on what u have discovered 

What state is he in?

this is important to know and u can look up divorce laws in his state for alimony and if the state is a community property state or  equitable distribution state.

 

i guess it would help if u had a place to live in the US

there is a lot to consider here

Completely agree. What ever it takes, get on flight USA now.  I would go through Dublin as there is a CBP preclearance station there.  
 

Once in the USA file your I-131.  
 

And tell your husband to start having over the stack of money each month that you are owed per the I-864: $1415 per month.

?? nothing is owed per the I-864.

Short marriages often result is short duration of alimony.  Federal law overrides state law in this case.  
 

The I-864 is an enforceable contract.

1) you should not have any issues at all. 

2) no he cannot

3) reentry permit is required if you plan to stay outside US for more than 6 months. reentry permit has to be applied from within US.. reentry permit is applied based on your green card status. if you marriage was entered in good faith, you should have no issues whether you divorce or not.

4) no your marriage is not an issue. you have. a 10 year green card

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
