Hey Folks....

I read in the AOS Guide on VJ that we should include copies of my divorce decree and my wife's annulment decree when filing the I-485 for adjusting status. However, when I read the instructions for the I-485 from the USCIS, nowhere does it mention needing those two documents. I'm confused now and asking what is the reason for including it in the AOS guide. I would think its a reasonable thought that its not needed because of the fact we are already married and that's why we can adjust status from K-1. Why do we need to prove we are free to marry all over again? Hmmmm...... :help:

I guess I think of it more as proving that I am legitmately married (by showing that my previous marriage was legally dissolved). Besides, if they don't want it, they can toss it; but if they do want it, I'd rather have sent it instead of getting an RFE for it.

I followed the AOS guide here on VJ to a 'T' and Claudeth received her provisional green card without an interview in about five months. You should have already had the copies of the divorce papers for the embassy interview so it shouldn't be any big deal to include them in the AOS packet.

I agree. I don't understand why USCIS keeps asking for the divorce papers. On the AOS interview checklist it also says to bring divorce papers with you at the interview.

Thank you all for your responses. I don't really have a problem with handing over another copy of something they already have anyway. I guess my question was more directed at the discrepancy with the AOS guide here on VJ. The guide, a non-governmental document, says to include them, but the instructions for the I-485 doesn't mention anywhere to send them in. I appreciate that most of you sent them in anyway and I guess I will likely do the same. As was said here too, and it makes sense, they will just throw it out if they don't want it. I suppose since none of us are the authors of the guide (as far as I know) then it will remain an unanswered question. Thank you again for your quick responses.

We did not send a copy of ours again. They saw my decrees when I went for my K-1 visa and this was available to my AO during our AOS interview. So, she already had it in my file. All I sent was the things they asked for on the I-485 filing instructions - nothing less, nothing more.

Skeeter211, I noticed this exact same discrepancy as well. I decided against sending it again as it was already sent with the I-129F. The FAQ guide here is just that, a guide. You needn't follow it like a bible. Use your own judgment. On the other hand, I don't think there's any harm in sending it again either. :)

We included it, AGAIN, for our AOS packet, and it was also listed one the Interview Notice as supporting documents to bring to our interview...

Guess you should just plan on proving to USCIS you are divorced up to three times during the K-1 process! :thumbs: Good luck!
