DCF for Ukrainian wife in Cyprus.

Yes, my husband and I did the DCF through Frankfurt. And there are all kinds of timelines, from being approved within 4 days to 3 weeks. I guess I’m just gonna wait 🙂  but I’ve seen your I-130 got approved and your process is going which is great 😊

Yes it was approved but the case has to be created with the USCIS. So I’m not sure when we can even do the medical. Did they tell you something like this?

No, they haven’t said anything. Just sent us a checklist with documents to send them via mail what we did. But they haven’t said anything about creating a case with USCIS. We are just hoping to hear at least something at some point.

When did you file?  They did not tell you if you were approved at the interview?

O interesting! They asked us some questions while filling. We have been waiting almost 6 weeks now for the case to get created and processed. I think Cyprus is not a set up for DCF as Frankfurt is. We were going to go to Germany but staying on Cyprus seemed more relaxing.

My congressman got this response from the embassy. I have been following up every month and cannot even get a USCIS number from the embassy. I don’t think they have received it.

Our records show that your constituent,***** filed an I-130 petition for Ms.

*******at the U.S. Embassy in Nicosia, Cyprus on March 24, 2022. The U.S. Embassy in Cyprus forwarded***** information to USCIS for an Adam Walsh Child Protection and Safety Act ("Adam Walsh Act") namecheck. We did not receive an approval from USCIS, so we were then contacted by the National Visa Center to transfer the petition to NVC. This office mistakenly transferred only the electronic case file to NC on April 4, 2022 (the case was opened too early in error in IVO and should not have a local case number). I discovered the error last fall and I transferred the paper file (the original petition) to NVC through Diplomatic Pouch in October 2022. NVC received that file on October 31, 2022 and transferred it to USCIS. Please see attached scanned copy of the Petition and the cover memo when I sent the petition to NVC in October 2022.

If USCIS can proceed with the photocopy of the petition, we await approval of the Adam Walsh Namecheck and we can continue with this case.

This certainly explains the administrative review by USCIS you mentioned previously. There’s nothing much you can do when it comes to background checks, this one is taking a while it seems. If your record is clean then probably your name matched someone who has committed an AWA crime. 
 

One other solution I’ve seen here is a filing a Mandamus lawsuit with a federal court to force a decision.

We have a rented villa and have bank accounts on cyprus.  I need to visit America for two months for business so we are attempting again for a tourist visa but, I doubt we will receive it. I will bring her back to Ukraine to stay with her family if we are denied the tourist visa. This process have been a nightmare.

Have you considered abandoning DCF and bringing your wife over via Uniting for Ukraine?

We just filled out the biometrics for Uniting for Ukraine. We are now just waiting on a travel date. Do we still have to abandon the I-130?

I meant it more as a metaphor, sorry for not being clear. You can leave your I-130 as-is while U4U is processing. No need to do anything on the DCF side.

Thank you for this excellent information. So we will be able to just fly back to Cyprus from the states when the visa is ready and finnish up the CR1 visa correct?
