Hi There, we filed for AOS in early march and we just got an RFE around our 864EZ where it says the following:

Quote

The petitioning sponsor on Form I-864EZ, Affidavit of Support, must submit W-2s and/or 1099-Rs submitted to the Internal Revenue Service for the most recent tax year.

When we had originally filed our AOS my wife had not filed her taxes for the most recent year but now we have that too so should we attach that with the W-2's or just send in the W-2's?

Additionally, the bottom of the letter also says:

In order to process your application further, you will need to:

  •  Submit a completed and signed Form I-864, Affidavit of Support, from the petitioning sponsor. All pages must be present and of the latest edition date.
  •  Provide the petitioning sponsor's Social Security Number on Form I-864.
  •  Provide a complete and correctly calculated household size for the petitioning sponsor on Form I-864.
  •  Submit a complete copy of the petitioning sponsor’s Federal income tax return and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) for the most recent tax year.

This says in order to proceed further we need to file the 864 with the all the required info(even though we originally filed 864EZ because we meet the criteria for that form) so I'm a bit confused if we need to submit the W-2s for the latest calendar year as asked in the first line of the RFE or file the I-864 or do both?

both quotes say "most recent year "   and soon will be the 18th of April so best to send 2021 as by time they review it,   that year will be needed and u don't need a 2nd RFE

Thats a good point! Any idea on if we need to submit the form 864 again? or is that just general instructions on all RFE's around this? Im especially confused about this because we had submitted 864EZ(which is what their first statement for evidence around W-2's says) but that checklist says 864.
