One other question -- did your J1 have a home residency requirement (HRR), i.e., you have to return to your home country for two years before you can get most work/immigration visas?  If so, that could be why the lawyer suggested an O1, however unlikely it is that you will qualify for one at this point -- it is one of the only work visas you can get until you have met the HRR.  If the HHR applies, how long were you outside the US before you got the F-1 and returned?

It all depends on the paper work that your lawyer is able to present. in reality your qualifications are pretty minimal for O1 but make sure you have a lawyer who has good credentials . They all will say they can do it. ask them for specific cases where they got approval. 

 

Get a damn good lawyer.. and make sure you vet them out.. have to you talked to multiple law firms ? what was the other opinions

Hello everyone, 

 

I am on F1 visa currently working on OPT. My OPT ends in June 8th and I am desperately looking for some solution to stay in here. I have been in the United States 7 years (first on J1 visa and then on F1 visa). I graduated from College last year and I got the associate degree in Professional Photography.  I am currently working as a studio manager and photographer at the small photography studio. The company I work for really would like to keep me but they contacted their lawyer and he told them they are a small company and it is going to be hard for them to sponsor me for a green card. I contacted few immigration attorneys and they did not give me any good solutions. One of them told me "It is hard to stay here" which I already know and the other told me to apply for O1 visa which I not have that many outstanding achievements. I have a couple go my photographs being displayed at the exhibition but it is was not published anywhere. I was just wondering if maybe one of you would have some suggestions or would be able go give me some possible solutions. I am from Poland and I was also wondering if because of the scary situation in Europe I would be legible to apply for an asylum. I know that Poland is not in a state of war and I know there is way more people who could use the asylum here than me but it was suggested by one of the immigrations attorneys I contacted. 

I would appreciate and be grateful for any suggestions. Thank you very much

I don't have an answer, but I thought one condition of an F1 is that you return to your country after your education .....is that correct?  Asylum?  Really?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Asylum is not for your case. You are not on a live or death situation. And for the asylum you will need to show proof of that. Is not just words. This is visa shopping.

 

You need a reason and a sponsor to be here. This is for all immigrants and your case are not different.

What specifically is going on in Poland that would guarantee asylum status here?

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

I came across a lady from Germany who wanted to claim asylum on a similar basis.

 

I would find an Employer who is willing to sponsor you for a work visa.

I am so sorry for you.  There is no path for you to stay in the US.  You know this.  You have been on VJ asking for different ways to stay.  There's no path for you.  Accept this.  

 

A false claim for asylum will get you a permanent ban from the US.  Not a smart move.  Ukraine got invaded.  Not Poland.  

A frivolous O visa is equally unwise.  

 

If you contact an honest lawyer, she would tell you the same thing that we are telling you.  Don't get sucker in by someone who will promise you the impossible, you pay a ton of money, and end up being illegal and deportable.

I totally agree with you. That is why I asked about it. Asylum was suggested by the last immigration attorney I spoke to. I told her that my country is not in war but she told me that situation in Europe is unstable and it is worth trying. 

I definitely do not want to be in the situation when I will be illegal or deportable because I do want to come back next year to visit friends that I have here. I guess I will enjoy the time I have left here and leave by the end of my grace period. Thank you for your comment

I get it. I mentioned that I was trying to research it. It was suggested by immigration lawyer and I was trying to verify the information. I am aware of the world situation

I have seen cases where it seemed like asylum was a long shot and a good lawyer helped it get through successfully.  My advice: don't try to game the system, as it could turn out badly.  If you can't find a US employer willing to sponsor you for a work visa (highly unlikely in photography but not impossible), then leave before you are out of status.  Good luck!

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
