Had to cancel my credit cards due to fraud. I-751 will get rejected. GC will expire in 5 days. Help!.

So I sent my wife's i-751 this past Saturday and it was delivered yesterday to the lockbox. I lost my wallet this morning and by noon I was receiving texts from my Bank about fraudulent charges so I had to cancel all my credit cards which means the credit card payment to USCIS will be declined and my wifes application will get rejected. Her green card expires in 4/10/22. I had just traveled for work-related reasons and I will be out of state for 3 weeks. Anyone have any experience being in a situation where your spouses green card will expire soon and your payment got declined? 

 

I know you can resubmit with an explanation and I plan to do that with as much evidence as possible showing what happened to my credit cards. I'm pretty distraught after loosing my wallet and the subsequent chain of events that will follow to my wife's application. I just tried calling USCIS to inquire about this but their system is having technical difficulties. I'm feeling pretty bummed about this. Does anyone have any experience or advice with this? Thanks.

Don't wait for it to be sent back.

 

Repackage. Use money order this time 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

You and your wife have NOTHING to worry about. Her status is fine, even though the plastic card expired.


Late filed I-751 can be / and are submitted even decades after missed deadline. Best case scenario, you will get the packet back w rejection letter. Worst case , a few pieces may be missing in the rejection packet, in the mailroom handling. 
 

When packet gets back to you ( likely not before you return home), just go through it to insure all pages are intact, include the rejection letter and a short explanation on payment card problem.

Just to add some more to what they were saying, you will be fine. Her legal status doesn't expire. What expires is her proof of status, which is her green card. Unless she needs to start a new job and needs proof of residency, she should be fine. 

So you can wait (I wouldn't wait decades as others have suggested), and resubmit when you get back. 

Second option: hopefully you made a copy of the whole package before you submitted it. Have your wife sign it, send it to you via FedEx overnight, sign it, and send it with a check and a short explanation of the late submission.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Just a suggestion.  Because of reasons like lost credit cards and possible fraud with checking accounts.  I would avoid using credit cards or even personal checks.  Instead, I suggest using money orders.   You can always check with the issuer to determine if its been cashed or not if you need to track it.

I have never had a single issue with personal checks. They are also very convenient to use because you can track when they have been cashed through your bank's app.

Call your bank.  If you tell them about a specific transaction that is supposed to happen, they can sometimes allow that one through.  

 

I don't necessarily agree with checks (really, cheques in my Canuck world) being better.  Credit cards come with fraud protection (the cheapest insurance one can have) and you can see instantaneously when a charge has occurred.  Considering the opaqueness of the entire immigration process, if your card has been processed, then you know your application/correspondence has been received.  You have no clue if/when that check is going to be cashed.  Mail can be hacked, checks can be modified.  All of a sudden your mortgage payment is missing from your account and the bank will not give you that money back.  With a CC, they will write the fraudulent charges off, give you a new card and send you on your way.  

 

I do, however, recommend that everyone set up text notifications for ALL card transactions on their accounts so they know immediately when a charge has been made or debited.  One can intervene immediately and call the bank before the bank's fraud detection systems take notice.  If we're making big purchases, the bank won't approve the CC transaction until we verify we are making the purchase via phone call or text.
