We sent in all our forms for concurrent filing of marriage based AOS, and were issued RFEs for some of the forms.

RFE as follows: 

 

For form I-485, under form I-864:

 

The petitioning sponsor, _______________ on Form I-864, Affidavit of Support, must be a United States citizen, United States National, or Lawful Permanent Resident of the United States.

Submit evidence of the petitioning sponsor’s status.

Evidence may include:

  • Birth certificate issued by a civil authority showing birth in the United States (must be a long-form birth
  • certificate which lists at least one parent's name)
  • Puerto Rican birth certificate (must have been issued on or after July 1, 2010)
  • Biographical page of unexpired United States passport
  • Certificate of Naturalization
  • Certificate of Citizenship
  • Department of State Form FS-240 (Report of Birth Abroad of a United States Citizen)
  • Copy of Form I-551, Permanent Resident Card

 

For form I-130: 

Submit evidence to establish that the petitioner on Form I-130 or decedent on Form I-360, __________, is a United States citizen or lawful permanent resident of the United States.

Such evidence includes:

  • Copy of a birth certificate, issued by a civil authority, showing birth in the United States (must be a
  • long-form birth certificate which lists at least one parent's name)
  • Copy of a Puerto Rican Birth Certificate (must have been issued on or after July 1, 2010)
  • Copy of the biographical page of the petitioner’s unexpired United States passport
  • Copy of the petitioner’s Certificate of Naturalization or Certificate of Citizenship
  • Copy of the petitioner’s Department of State Form FS-240 (Report of Birth Abroad of a United States
  • Citizen)
  • Copy of the petitioner’s I-551, Permanent Resident Card

 

The beneficiary, ________________, on Form I-130 must submit a properly completed and signed Form I-130A, Supplemental Information for Spouse Beneficiary. 

All pages must be present and of the latest edition. The latest edition of Form I-130A can be found at the USCIS website at www.uscis.gov.

 

 

Submit the marriage certificate between the petitioner, __________________ and the beneficiary, __________________. The marriage certificate must be issued by the government agency authorized to issue the document. For immigration purposes, the marriage must have been registered with the government agency authorized to register marriages from the location where the

marriage took place. The marriage certificate must have the seal of the issuing office, the date of registration, and signature of the registrar.

 

 

On the RFE instructions  on how to submit the documents, it said

 

  • You must submit the requested information by June 26, 2022. You must either mail the requested information to the address shown below or scan and upload your response using your USCIS online account (if applicable).

 

and so we did through the option on our USCIS online account (it had the option to respond and upload documents - we uploaded the scanned passport biopage of petitioner and CRBA, scanned I-130A, and scanned original marriage certificate, front and back).

 

They updated our status and said that they received our response. But I'm worried because I don't see uploaded RFE responses that often. Should I send physical copies as well?

I'm not sure about replying via mail once you have already replied online...seems a bit risky to me as it could cause confusion, but I could be wrong.

 

In terms of uploading RFE responses, I did that for my RFE that I received on my I-485. I have had direct confirmation that it was received and reviewed. It took forever to review it (around 4.5 months), but I doubt this is because I did it online rather than via mail. So in case you were worried about whether uploading RFE responses actually works, it does.

You're right, I'm worried about it. Thank you for sharing your experience.

I was a bit worried too at the beginning, but in the end it was fine. I also sent messages asking for confirmation via the internal messaging in MyUSCIS, and I also called and chatted with EMMA. They all told me that it had been received, and lo and behold, it had :) 

 

So, you can explore those avenues as well to put your mind at ease, but it sounds like you don't have anything to worry about in terms of them receiving the evidence.

It does say on our account that it was received! There's that. Just nervous because I don't read a lot of posts here re: online responses to RFEs.
