We are in the process of filing the I-130 for our daughter and grandson. We understand USCIS is expediting cases for Ukrainians. Does any one have experience or information on whether this also true for applications filed since the war started?

The issue is more the wait for the PD to be current rather than the processing time.

Hi Boiler,

 

Divorced. 

 

I'm not sure the PD being current is as relevant with expedited Ukrainian cases. From what i have heard people filing as recent as 2021 are getting approvals when requesting a expedite.

So F1 which is currently Dec 2014.

 

I am sure you could get the I 130 expedited but it would still need to sit and wait.

Visa categories for which there is not a visa available will not be expedited, unfortunately.

From the Department of State memo -- https://travel.state.gov/content/travel/en/News/visas-news/information-for-nationals-of-Ukraine.html

"Please be aware that expedited case processing does not apply to family preference visa categories where a case is not current."

 

Those expedited cases from 2021 that you may have heard of are only for immediate relative categories -- ie. spouses, unmarried children under 21, and parents.

A current PD is essential and completely relevant.  It doesn't matter that it's Ukraine.  There are no exceptions.  People in the family preference categories MUST have a current PD in order to qualify for an immigration benefit.
