What is your status in Canada and interview location? 

I submitted all documents on April 2022 and now got this msg last Friday -

"The Canadian consulate requires non- canadian citizens submit  proof of eligibility to have their visa interview in Canada. Currently Canadian legal permanent resident cards,landing papers, student visa, work visa are accepted for Canadian eligibility requirement. Please submit proof." 

My interview location is Montreal Canada which is written on left side of the nvc portal. 

Now I am worried I don't have any such document in my hand it will take time.

That’s not cool. Why don’t they let you transfer your case to a different consulate?

 

I am on a work permit and my interview location is Seoul as I am a South Korean national.

Haven't you mentioned your Canadian residence address in your current address on your application??

Yes but I was still assigned Seoul. I always assumed it would be in my home country anyways unless I specifically request otherwise. Am I mistaken?

Are you the beneficiary or the petitioner? 

I am the beneficiary and when I completed my I-130 my last two addresses were Korea-based. I got a SEO code when they transferred me to NVC

 

I know if you move to another country after I-130 you can write NVC and request they move you to another consulate (you have to show proof of residency though).

Sometimes USCIS/NVC get it wrong and schedule you for an interview in your home country EVEN THOUGH you chose Montreal/Canada and had a Canadian address on the I-130... it happened to another member. They were scheduled to interview in their birth country even though they had another citizenship AND they had never lived in the birth country 🤨 

If you want to move your interview to Montreal you can do that... just email NVC and request a transfer. It might slow down the case a little but you won't have to travel to Seoul (unless you want to travel to Seoul).... Currently it takes 60-75 days after DQ to interview for Seoul... but they also sometimes send out interview letters late and you only get 2 weeks notice. 

 

How do I transfer my Immigrant Visa case from one embassy or consulate to another?

If you would like to transfer your Immigrant Visa (IV) case to another embassy or consulate, please follow the steps below:

  • If your case is at a U.S. embassy or consulate, contact the potential gaining U.S. embassy or consulate in writing to request a transfer of your case.  Please include a justification for the request.  If you are not a resident of that country, specify that in your request.  

  • If your petition is being processed at the National Visa Center (NVC), contact the NVC to request the transfer.  NVC will transfer cases to another IV processing post if parties provide a written request along with the address in the requested country and the proof of eligibility (citizenship/legal residency in the requested country or other documentation). This can be provided at https://nvc.state.gov/inquiry.  In limited circumstances, NVC may need to contact you for additional eligibility requirements.  Note that transferring your case might not result in immediate processing as cases are processed in order based on the date the case became documentarily qualified.

Yes, thanks for this answer. All clear now. We have things to take care of in Seoul also, so it's not a problem for us.  I thought we would simply fly over to Seoul as soon as we get DQ'ed to prevent potential delays (covid, etc). Does that sound reasonable? I know in some countries there can be a longer delay between DQ and IL, but it sounds like Korea does not have this issue.

Yeah... I've been tracking DQ to interview dates from December and DQ-Interview is about 50-76 days. I follow mijunmo (the naver cafe) to see when people get their interview letters/ interview. And currently the latest interview date I've seen was August 4 (DQ May 28- Interview letter June 16)... 

I'm hoping we get an interview in late August... but it could be early September... Your plan on moving back to Korea after DQ sounds perfect!

I just realized I uploaded my 16 year old daughters police certificate under optional documents for civil documents.   Preparing myself for an RFE now 😢

I've seen cases where NVC just moves it to the correct required section and accepts anyway so don't lose hope yet!

They moved my PCC from "optional documents" to civil and I was DQ'ed don't worry about it.
