Timeline

Hello all,

My husband had his biometrics appointment on March 21st and he called USCIS, and it's going to be at least another 2 months(I think) before he even gets anything saying he was approved or his EAD card. What is the interim EAD I keep seeing talked about? My husband NEEDS to be working right now. Is there anything we can do so he can start work sooner? If anyone knows, please respond. Thank you

The only other way to be legally able to work is to have received the temporary EAD stamp at the POE at the time of entry into the U.S. with the visa.

Other than that, you have to wait for the EAD to be approved.

The EAD's are approved fairly quickly, and USCIS always gives the worst-case scenarios when giving out dates, so I wouldn't worry that it will take as long as they say.

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

The interim EAD you talk about is (in theory) issued to EAD applicants who have been waiting longer than 90 days since their NOA date. If you reach 90 days and still don't have either an approval or a denial then you can arrange an Infopass appointment at your local USCIS office to request an interim EAD. You can make this Infopass appointment on any day on or after the 91st day from your NOA date.

If you received any RFE's in connection with your EAD application then I beleive that the 90 day count would start from the day that the USCIS informed you that processing had resumed.

If you have not been waiting 90 days yet, arranging an Infopass appointment will not result in an interim EAD being granted.

Please be aware that different field offices interpret the guidlines in different ways.

If you put your timeline up people would be able to give you better advice.

In the past (so it would seem) people usually either got their EADs or RFEs within a week of biometrics. If you did not receive a RFE you should get your EAD soon. Good luck.

I got a temp EAD card by walking into my local office... I was lucky that they allowed this. They gave me a 3month card which covered me until I got my real EAD card. Not sure where your local office is but its worth a shot.

It took about 6 weeks from when Claudeth had her biometics to the arrival of her EAD.

Just for the record I had my biometrics at the back end of July but didn't receive my EAD until late October !! I received an RFE associated with my AOS application but was assured by numerous people that this wouldn't have had any effect on the processing of my EAD application.

Like everything to do with the immigration process, timelines are totally fluid and can vary wildly from case to case for no real explicable reason.

I filled for my EAD in Nov and now it is April. I had my biometric done on 1st March - on Friday 31st I went to the immigration office to see if I could get a temporary EAD as my EAS was over the 90 days. They informed me that my EAD was approved in Nov and they have not sent me anything - they could not give me a temp one as my EAD has been approved so hopefully it should come int he post.
