Joint Sponsor needed ?

Hello my 2021 Tax return income is below the 22k for 2 persons ( me and my husband) and since April 2021 I started a new job with 26k per annuam and I have my Paystubs for the previous 6 months and my Verification employment Letter as a my current income  evidences ( 26k).

 

1- Does The CO will ask for a joint sponsor ?

u did not fill in a timeline so hard to know where u r in this process

when did u file?

need to know so we know what year's income statement is needed 

Are u looking ahead for what u need or at the NVC stage now?

Hello Thannks for you reply 

 

We got dq using my sister as household member but now she is refused keep being so we are waiting the IL.

 

my three previous years were weaks but i started a new job year ago with 26k for me and my husband

Your salary is borderline, so they can, and likely will ask for a joint sponsor.  I would have one lined up just in case.

Thanks but if i will use a joint sponsor who own a business and his 2021 tax return of  2021 is below could i use his current income and his bank statements as evidences ?

"Current income is king" vs prior year income on tax returns.

 

I'll defer to @pushbrk to clarify that in the context of joint sponsorship.  Sometimes it is more challenging for business owners/self employed since they don't get W2s.

The Joint sponsor have his 1040 and his W2

The FPL guidelines are simply guidelines.  The CO evaluates the public charge risk based on a totality of circumstances, so with your income being marginally above the minimum you may need the joint sponsor.  You are still the primary sponsor.

I undersand my husband is graduated and he is working as CSR on his homecountry and he will keep working that job in the US

For the self employed, "income" IS the number appearing on the "Total Income" line of their most recent tax return.  I think the OP is confusing business revenue with business income.  Income is what's left when you subtract business expenses from Business Revenue.  Sound like the potential joint sponsor has a negative total income, so would not qualify.

26k for a household of two is technically over the minimum, but marginal.  If it's the best you can do, it's the best you can do.  You mention your husband will keep doing the same job in the USA.  Will it be with the same employer?  If so, get a letter from the employer stating he will transfer to a US job and at what rate of pay.  You can then add his income to yours right on your I-864.

His income will only count if the job is the same and will continue in the US.  Getting a new, similar job in the US will not count for the I-864.  Read and re-read the I-864 and its instructions.  You can also add liquid assets if you have any, to strengthen your case that you have the financial means to sponsor him.  Good luck!
