Abandonment of LPR I-407

Hello 

 

in January I filled a 1-407 and submitted my LPR therefore abandoning my green card. I haven’t heard Anything from them but I don’t know if I should? 
 

I’m hoping to visit some family for a few weeks the beginning of August, it would of been 8 months from submitting but I’m scared that to book my flight yet incase my esta gets declined and I’m afraid of filing for an esta incase it gets declined because the 1407 hasn’t yet been processed lol 

 

Anyone had any experience?

I tend to think your ESTA is long gone

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Timeline

The USCIS processing times estimate 2 to 2.5 months to process the I407, so you should be good by now.  You may try contacting USCIS to find out the status, but other than that I would not worry too much about it for your trip in the next 8 months or so.

Can you please share /post the USCIS source that u are relying on for ESTA …. I also think your no longer ESTA eligible and will need to apply for B-2 , facing uncertainty even there. ESTA is an automated system and anything out of the ordinary ( like I-407) not likely to clear. 
 

I also do think you will get any confirmation of I-407 processing, ..they got , shared and flagged other agencies ..upon receipt. 
 

The only way you can be sure if u have ESTA chance is to apply..don’t think waiting will change the outcome. Good luck

Thank you I’ve actually just got off the phone to them and they said they haven’t received anything 😭 damn international travel. They’ve requested for a tier 2 officer to contact me within 30 days. I get such bad anxiety about visas etc 😭

For all intents and purposes I agree with @Timona that esta is neither  an option  nor should it be attempted until B visa backlog eases.  Here is my reasoning.  

 

You’ve 3 practical choices 

 

1. apply for esta now.  
 

2.  don’t apply for esta and instead apply for eta and travel to Canada and enter USA by land.  
 

3. don’t apply for esta or eta and instead travel to Mexico and enter USA by land. 
 

Analysis: If you try 1 and are denied, even though the letter of the regulations says you can try entering by land, the spirit of the regulations are that if esta is denied you should apply for a B visa instead, even if entering by land.  Given timelines for B visas not practical. 
 

If you try 2 and Canada denies eta you can do 3.  
 

Summary: fly to Canada or Mexico and enter by land.  When B visa backlog becomes sane in several years, apply for esta then, and if denied apply for B visa. 
 

Hindsight lesson: Never  file I-407 with USCIS.  Instead, on the next trip to the USA, use gc as travel permit in lieu of esta.   At a port of entry tell CBP officer you wish to file I-407 and would like a multi entry multi year B visa in return so that you don’t  get esta denial glitches on future travel.  The officer might just give you a single entry B visa, but since CBP has seen your I-407, odds are higher esta will work the next time.

I’m having the same issue. My application and greencard was delivered on 4th Feb according to tracking, but I have received nothing since. The website says anything received before 8th Feb is outside of normal processing times but I can’t find a way to contact them. 
 

They have a link to contact them online about it being outside of normal processing times but it doesn’t have form i-407 as an option when filling out the info. For some reason Skype won’t let me call the USCIS number either so I’m not sure how to follow up on this. 
 

My understanding is that you get a notice which confirms the exact date in which it was abandoned. This is obviously very important because until then I have to continue filing US tax returns despite not having my greencard or living in the US! 🙄
