parents immigration under process but can they travel on B1-B2

Hi

Plz advise as my parents immigration is under process but we are tired of waiting. my kids want to meet them and I am missing them. we cannot travel as my kids have school can my parents travel on B1-B2. Will it affect their immigration in any way??? My sister is also on b1 b2 can she travel with them to visit me as well

 

plz help and clarify both things

Timeline

They can visit with a valid B2 at the discretion of CBP.  It will not impact their in-process petition unless they were to misrepresent themselves in some way.

Visit on a B2?  Yes.....at the discretion of CBP.  Come to the US via a B2 and stay?   No.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The burden is on them to convince CBP of this.  The best advice to give them is to never, ever lie to CBP.  Do things the right way.

I travelled on my B1 B2 visa as I waited for my immigrant visa (CR1) to be processed.  They just need to be honest with the questions asked.  Also the CPB officer never asked about my immigration petition just asked purpose of trip and length of stay.  Never had an issue.

Service Center - Nebraska

PD - January 26, 2017

NOA1 - January 31, 2017

NOA2 - November 3, 2017

State Department - Sent November 7, 2017

NVC Received - November 9, 2017

Consular Interview - January 5, 2018

Port of Entry - Miami on January 19, 2018

 

ROC Mailed - December 14, 2019

ROC Rec'd - December 16, 2019

E-Notification - December 19, 2019

ROC sent to National Benefits Center (MSC receipt #)

Cheque cashed December 20, 2019

Ready to Schedule for interview - October 7, 2020

No ROC interview

New card is being produced - August 16, 2021
Card received - August 23, 2021

 

 

N400 -  Online

Filed - July 19, 2021
NOA - July 24, 2021

Biometrics - August 16, 2021
Interview - December 14, 2021

Approval - January 27, 2021

Oath Ceremony Notice Mailed - March 17, 2022

Passport Book and Card in hand August 12th and 14th 2022.

I think travel is possible on b1/b2 depending on which country they are traveling from.  For how long have you been waiting after the DQ???

1)my parents DQ was done march 2022 from Abu dhabi embassy. What is the wait time till the interview letter?  Can Parents come visit me in summer from june to August while waiting for the IL. What happens if they get a IL in dubai during this stay. 


2) my sister has b1/b2 as well. Is it good if she travels with parents to come see me? Or this can be a problem in anyway?

1. They can certainly try, CBP may  or may  not let them in. If you are worried about an interview letter arriving while they are away, have someone check the mail and book a flexible air ticket so they can go home earlier to attend the interview if necessary 

2. So vague as to be unanswerable…absolutely no information about your sister

For sister But she has a valid visa. Can it be an objection in anyway i mean so many people visit usa

A  valid visa doesn’t guarantee entry. It’s not the number of people who matter (3 is hardly “so many”), it is whether CBP believe that they will return home and not overstay their tourist visas. Seeing as you have given no details about u sister this question is unanswerable (the answer is probably  different for example if she is married with 3 kids, a husband and a powerhouse job at home vs if she is 22, single, has no job and is not at school …)
