Marriage online or overseas for CR1

Hi everyone,

 

I recently got a job offer back in the USA and am thinking of taking it. I am an American citizen so it’s not an issue for me. My fiancée is German and cannot come with me. We tried to get married two years ago in Denmark (twice), but because of Covid, that didn’t work out. My question is that if use one of these online services (Utah) to get married, would that be a way to get married that lets her eventually come to the USA with me? We’ve been together for over six years and have lots of evidence to support this. We’d be together for the online wedding, so consummating the marriage wouldn’t be an issue. We want to get married this way simply to get it done after waiting so long. Is there anything I should be aware of? Thanks for any advice!

It sounds like a good plan to me.  Seems to me that a Utah marriage would be the perfect solution for you.  Others might be aware of some cons, but I am not aware of any.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

A Zoom wedding will work, and you can file the I130 as soon as you have the marriage certificate.  You can also look at doing DCF as an immediate relocation of the USC due to a job may sway the consulate to accept your I130.

Thanks for the reply. I have to ask what is DCF?

You can go either way from outside the US.  First step is to get married and receive your certificate.  DCF is much faster than regular consular processing, a matter of months.  If you both live in Denmark, you start by contacting the US embassy in Copenhagen via email to ask if they will accept your case.  They may ask for documentation to make a decision based on exceptional circumstances.  If they decline, you will have to go through normal consular processing which takes 1-2 years.  Good luck!

This is from a different consulate, but it lists the exceptional circumstances that may persuade a consulate to accept an I130 application.  Also, I have attached a pinned thread for those that have recently filed DCF under this rule.  As @carmel34 mentioned, it is much faster than regular processing, however it still takes some time (i.e. it is not immediate), so you need to look at your exact situation, when will you be married, when will you be in a position to file the I130 with all the required documents, vs when you need to relocate and when your future spouse will be able to relocate.

Just a caution.  Zoom wedding and Utah County marriage are not necessarily the same thing.  A Utah County wedding via Zoom is pretty common now.  The Key though is Utah County, not Zoom.

I am aware of this, but you’re right to be specific about this in order not to confuse others.
