I misstated something.  "Visa with a waiver" indicates a ban since a visa, alone, normally allows entry.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

So what happens next is up to the CO when you interview for the K1, the PoE certainly seem to believe you misrepresented yourself, but that waiver comment has no particular standing, it is up to the CO is he thinks the situation os that bad to require a waiver. 

 

So keep your fingers crossed.

 

CO is the person who will interview you for a K1, the K1 is not a particularly good option but that is another story

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

You don’t need a waiver.  Continue your K1 path.

Something made them think you were coming in to adjust status.  Did you pack furniture or something?  Bring the goldfish and cat?

Thanks! What makes you so sure I don’t need one?

No I packed light but they looked through my phone and electronics which I was not expecting

IF you have a Refusal letter IN YOUR hand , post interview, and you are NOT hiring legal help … then you have to REALLY learn some legalese to argue w Consulate exactly what you learned from attorneys so far: argument being you don’t need a waiver ( no misrep /fraud finding and allowed to withdraw ) BUT because it’s a K-1 and not a marriage to USC…its soooo contingent on the moon, stars , discretion…

 

If you intend to give it a DIY shot , then do much much research just using sec 212(xxxx ..perhaps in the AAO ( those who filed I-601’s ) to find the words you might use to argue why that section does not make you subject to/ inadmissibility finding thus does not  require a waiver ( I-601) This part is basically done over email w consulate ..

 

You HAVE NO ban ( so don’t look at I-212) . 
 

You have come so far , if you already had your interview, it’s worth trying your utmost ( hiring attorney, your fiancé can appeal to Congressman  .. )…if all fail, get married and start I -130
