Hello, 

i could really use some help with my case. 
i was denied entry on ESTA for seeking immigration benefits without an immigrant visa. I was told I could come back on a visa. 
I requested my FOIA and it shows things on the sworn statement that were not said to me. And all paper work says I need a waiver. It says I must obtain a visa with waiver for future entries. But I wasn’t accused of anything, when I try to get a waiver none of the subjects apply to me. 
Every lawyer I’ve spoken to has told me I should not need a waiver.
but then why does this paper work say I do? Which waiver category do I need?

For a K1 the waiver could be I 212 for being deported and/or I 601 for Misrepresentation.

 

You will find out when you interview if you need a waiver and if so which.

Could be an expedited removal.....which has an automatic 5 year ban.  See @Boiler's comments above.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What is misrepresentation? I was never accused of it, I told the truth. And I was not deported I withdrew my application for admission. I was denied under section 212 (A) (7) (A) (I) (I).

and there’s no waiver for that. Which Is why I’m confused.

No i withdrew my application for admission I didn’t get a ban

If you did not get a ban why do you need a waiver - for a ban.

Waivers apply when a person is inadmissible....even with a visa.

All I know is what you have posted, you said you had a ban, if you do you need a waiver most likely, if you do not then you do not need a waiver.

Same thing......a waiver with a visa indicates a ban.
