There is more to this story.  If your timeline is correct, then there has been an error at USCIS.  NVC schedules spousal visa interviews, not USCIS.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

So I managed to get through the ridiculous USCIS IVR and speak to a person but they weren't much help.

 

What they could tell me was that an interview has indeed been scheduled, but that its in Hartford CT which is no good to me because we live in England which would have been very very obvious from our application (not to mention our original receipt notice came to us in England).

 

She tried to reschedule my interview to the London Embassy but could not because my "zip code" is not an American zip code so the computer wouldn't let her do it.

 

Most ridiculous of all was that the official USCIS advice in this situation was to contact an immigration lawyer to help us with the case.

 

She did escalate to a tier 2 case officer but that only means I'll get a call back within 30 days. And by the way my currently scheduled interview is in 31 days! I have no confidence I will receive this call as the person didn't seem to understand international phone numbers.

 

Now I will say say the lady on the phone was very nice, and clearly was trying to help us, but the tools at her disposal were not fit for purpose, and basically I feel more uncertain now than I did before I spoke to USCIS.

 

Guess I'll dip into savings and hire a lawyer.

No need to hire a lawyer if you have the time and patience to pester USCIS yourself.  Keep calling the USCIS hotline or chat with Emma online at the USCIS website until you are able to talk with an agent who understands your issue.  Tell them that your beneficiary is pursuing consular processing for a visa, not adjusting status in the US.  Request that the I-130 be transferred to NVC so the case can proceed with visa processing abroad.

 

Note that some USCIS agents might mention that you need to file I-824 to transfer your petition from an LFO to NVC.  You do not need to file I-824, unless you indicated in your I-130 that your beneficiary is adjusting status in the US (review your answer to part 4, item 61).  If you properly left that part blank, then it was really USCIS' mistake in transferring the petition to Hartford LFO, so you should not be made to file I-824 for USCIS error.

To those that may be interested in this thread. Last week we paid £550 for a legal consultation with an immigration lawyer. We had the consultation on Monday afternoon, and the lawyer then agreed to advocate for us for no extra fees. We signed a form allowing him to represent us. In less than 24 hours our I-130 petition status changed to Case Approved!

 

Shame we had to pay for a lawyer, but worth the money for the rapid result.

 

I suppose we now wait for the NVC stuff to come through.

Congrats on the approval.

Make sure all your NVC documentation is ready and correct. You want to this stage Right the first time to void unnecessary delays.

Processing time of submitted documents at NVC is 3 months, you will hate to get an RFE after three months of wait
