Goodmorning

 

Im the USC main sponsor for my husband , My recent tax 2021 doesnt meet the required income so i decide to use my sister to combine her salary to meet the guidelines.

 

here is the main situation :

 

- My sister came back to lives with me in my house but on her drive license and her paystubs and her 2021 tax retunr shows her old address , so how can we prove that she came back to lives with me ?

 

- My sister 2021 tax return doesnt meet the required income so after combine her salary with mine will drives us to be qualified ?

 

- My sister 2021 tax return shows that she is a head household , that's can be an issue ?

Timeline

Tax returns do not have to meet a specific income.  That is a misconception.  CURRENT ANNUAL INCOME IS KING......not what you earned in past years. 

 

Current annual income is calculated as:

Most recent pay period gross income multiplied times the number of pay periods per year = current annual income.

Example:  Last week's pay stub shows gross income of $1000.00

CURRENT ANNUAL INCOME = $52,000.00

 

Maybe you don't even need a joint sponsor.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

1. Go to DMV or online to change her DL / license address to urs.Copy of he DL w change of address if it’s not on plastic card Lic is sent to USCIS . Also have her update address w employer to show on her next /“ current “ paystub 

 

 

2. You do I-864 , she does I-864 A and your incomes get combined 

 

3. No issue if she shows head of household, just make sure u add and calculate income considering  her number of dependents ( so if her household has 2 ( she and a child ) and yours 3 ( you, your spouse and a child) then ur combined income requires is for a household of 5

1- I will try to add my sister name on my rent lease ,that can be good enough ? could my sister write statement indicates that she recently move to my house ?

2- Does my sister income should be above the HHS N to combine her income with mine ? cuz her income now is above !!

3- so our household now is ( me , my husband my sister and her son ( Which is dependend on her tax return but he lives on my sister old address ) so we are 4 or 3 household member ?

If she qualifies on with only her income ( not using her husband’s income or perhaps he does not want to sponsor), then she does exactly what other member recommends, file I-864 as co sponsor  

 

DL and paystubs is how u establish requirements, anything else may or may not help and leave u vulnerable to delays, RFEs

-She unmarried mom her income is below so i will combine her income with mine , is that ok or she needs her income above only to be a co sponsor ?

- DL is old , she recently came back to my house and my case is dq already we are dealing with embassy now

If her DL is just old, do a change of address online, and do a change of address with her employer for paystub, even if u don’t want to wait for a new paystub. If old DL= expired DL…then give submit what you have and maybe go to US Post Office and do address change/ mail forwarding to add

Your sister is stand alone no matter where she lives

One of you has to meet all the requirements to sponsor an immigrant.

Who May Be Considered a Household Member for Purposes of Form I-864A?
For purposes of this contract, one or more of the following individuals may sign the Form I-864A as a household member if at least 18 years of age:
1. The intending immigrant, if the sponsor seeks to rely on an intending immigrant’s continuing income to establish the sponsor’s ability to support the intending immigrant’s spouse or children;
2. The spouse, parent, child, adult son or daughter, or sibling relative of the sponsor, if that relative has the same principal residence as the sponsor; or
3. Any other individual whom the sponsor has lawfully claimed as a dependent on the sponsor’s most recent Federal income tax return even if that person does not live at the same residence as the sponsor. If more than one individual
