Ukrainian Migrants Find Easier Path to Enter U.S. at the Mexican Border

I wonder if you could just get it at say Dublin, that would be much simpler.

Questions for those who went through the border-crossing route:

 

- If you claimed humanitarian parole and had a K1 or marriage visa application already pending, did you let the officer at the border now that you have a pending K1 or marriage visa application or did you withhold this information?

 

- If you claimed humanitarian parole at the border, did you have to apply beforehand (as described on the USCIS website) or did you simply just show up at the border?

 

- Is it harder to AOS after having gone through humanitarian parole vs K1 or marriage visa?

 

- While doing AOS after entering via humanitarian parole, will you disclose information about having attempted to go through the K1 or marriage visa process but later switching to humanitarian parole?

1) they haven't asked for it, but we prepared to say about it if necessary

2) Nope, i heard it takes about 2 months to hear back from USCIS if applied through mail 

3) Not a lawyer but i believe it's the same. The only thing is that we have to provide documents with i-130 showing that our marriage is real and I'm not sure what we can provide. My fiancee ( wife soon) doesn't have a SSN so we can't open a joint bank account and I can't add her to my mortgage. I'm figuring out what can we use as an evidence of Bona Fide marriage. 
4) I don't know if we need to? I'm planning to mail USCIC a withdrawing letter of our 129F because of our marriage though.

Timeline

I am thinking to apply AOS for my current finance, who has came through the Humanitarian parole , once I get married this Thursday. Do I just follow the instruction in the this thread or need any additional steps?

Pretty similar to what you would have done, add on the I130 and you need a medical.

1. Don’t worry about bonafides too much and a copy of the the I-129 F receipt will actually add positives to the relationship. But if you want some ideas…


2. You can add her as POD ( payable on death) beneficiary to your bank account if the bank refuses to add her as joint or POA ( power of attorney) as a non resident. Both POD and POA can be changed/ updated anytime u want in the future 

 

3. You can download a Health Care Directive POA ( for ur state) and https://oag.ca.gov/sites/all/files/agweb/pdfs/consumers/ProbateCodeAdvancedHealthCareDirectiveForm-fillable.pdf 

 

4. If you have Costco or AAA , just add her name 

 

5. Go to DMV and apply for a Drivers License ( just for the application itself which  will have ur joint address) ..if they give u a tough time, insist on License for Undocumented ( example CA has AB 60 Law)

 

6. Call or go online to ur utility companies ( gas water electric  internet ) and change your mailing address to : Mr Ray Hero

   C/o Mrs. Julia Hero 123 Happily Everafter


There  will be NO difference in your AOS as a result of entry w humanitarian parole.

There is also notice that will publish tomorrow as far as TPS for Ukrainians: change in date to those in the US as of 04/12/2022.

My fiancee made it through the Mexico border. At the border she gave my name and address and relationship as friend. They went verified and came back and asked her just one question "Is he really a friend?". Since she is 7 months pregnant, she said "he is father of my baby". She felt bad and wanted to say something to correct her mistake. But they just left asking her to wait. They  came back few minutes later and asked many questions like how many times I have visited her, and when did she got pregnant, bunch of questions on the relationship. Since I took her to India to meet my family, they asked more question on whom all she met. After 30 minutes wait, they gave her the parole for 1 year. 

 

My question is, since she wrote that I was her friend in the first form she filled at the border, would that going to come back and haunt us at AOS, Greencard or Citizenship ? I am little worried. Appreciate any help.

In the future she should just always be honest. I don't know why she said "friend" in when she was actually a fiancee. If she got HP for a year, then sounds like she's good so far. Next step is to marry and adjust status.

Shouldn't be a problem but if they ever ask her why she said "friend" instead of fiance again she needs to explain herself. I would just assume somewhere they made notes about what she said so better to be prepared in case it ever comes up. Always better to be safe than sorry when it comes to immigration.

I am the one who told her to add me as friend :( I heard from someone that no questions were asked. and the line is moving very fast. well..I will take the responsibility for this mess up.

 

We got marred last Thursday and I will start the AOS process. Thanks for all the responses. I feel better and definitely prepare for answering that question if that comes up later.

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
